this has happened a couple of times so I will give you one specific example:
arrived at the yard for 7am only to be kept hanging about till 9am waiting to be loaded. I did not do any other work, just sat in the canteen drinking coffee.
got in the cab at 9, did a manual entry putting 7 til 9 as poa, did my 15 min checks then off I went. stopped at 14.30 for a 45 min break, then carried on my driving.
I didn’t go over the 4.5 driving hours, but got pulled into the office to sign an infringement that I had gone over my 6 hrs wtd and was told that I could be fined 300 quid per offense (there were 3 separate offenses)
I thought poa didn’t count towards wtd, am I wrong on this?
more worryingly my boss has told me to stop doing manual entries to stop this happening in future.
I only know how to do printouts from the current day, and I don’t know the dates when the infringements happened anyway. I could ask the boss but now it’s over with, I just want it forgotten where work is concerned.
all 3 infringements were the same, poa for a couple of hours in the morning done as a manual entry, causing me to go over the 6 but only if poa counts for the time.
if you can explain to me how it’s done, I will do printouts for the last 2 weeks because I know the infringements happened in that period
No POA doesn’t count towards your WTD. So how did you get an infringement? I think it’s probably one of two things. Either you totally cocked up your manual entries, meaning your POA wasn’t recorded correctly. Or you somehow have got your times mixed up.
I would hazard that it’s probably the first one because you don’t seem like you know your way fully around your tacho head. (don’t worry, plenty don’t, it comes with practise, even then your never perfect 100% of the time.)
Like Roymondo says, it’s impossible to give you an accurate answer as you can’t produce a print out for the days the infringements occurred.
Lastly your boss is a knob for two reasons, firstly that time does need to be accounted for, it just doesnt necessarily need to be manually put on your card. Secondly, when he gives you an infringement notice to sign, he is meant to explain, how you got the infringement, and what you can do to avoid it next time. It’s not meant to be him shoving a piece of paper under your nose, and you sign, and don’t read and fully understand it!

Yes it’s a bit confusing to start, but you will soon get the hang of it after making a few mistakes!
Just always do a print out and write out the error you made. That way if you get stopped by DVSA, they will probably be more than happy with your explanations of the errors. But if you don’t have the printouts already done, then you’re going to jail mate!

Fair enough, good luck, practice them manual entries at your new gaff, they aren’t something to be scared of. They are a tool for you to use to make your life easier, not harder.
cheers f reds, I think I have got the hang of manual entries, I don’t know it all by any means but I know enough to make my manual entries for my purposes. I’m not the only one it’s happened to. one of the full timers was adamant that if I started at 7, I had to have my wtd break by 1pm even if the first 2 hours were poa, which would mean I had only done 4 hrs driving and other work.
I think the whole place is labouring under a misapprehension. the software used to analyze the cards is what is spitting up the infringements and that is what is to blame, the management is just acting on the information given. it’s no excuse, but in this case I think it is the computers fault or at least the way it’s been programmed
anyway, it’s all by the by now, I’m off to pastures new.

Don’t start or finish your day with POA or break. When doing a manual entry start with 5 to 10 minutes other work then POA.
Only needs 1 min a show of work followed by poa. Someone had to inform you
Why is this buddy? Also in my first year of this game and i do manual entries all the time. So far (luckily or otherwise) ive not had any infringements but when i need to have POA at the start of my shift i never register a minute of other work before it.
Basically i go back update my other work finish from the shift before, stick it on rest in the next entry, update other work or poa for start of new shift…
So if in future im putting in POA for the start of my current shift on line 3 i should be doing that line as 1 min other work and then line 4 as POA if its required?
Never had this explained or seen it written anywhere before.
Because you would have to know you were going to be on POA in advance, ie night before.
If you’ve gone to work and the office say theres nothing available until truck xyz comes in at 1 hours time go sit in the canteen, while you are receiving the instructions you are working aren’t you. So you would have to record that as at least a minutes work.
