My 2nd point is completely right, it’s what you said as well in different words, you’ve just not understood me. But don’t worry, it seems not many can. You understand the legislation which is all that matters.

I was talking about about a 30 min break so I was referring to a shift of 6-9 hrs
“total shift less 6 hrs” I was trying to say you can’t have your t
30 mins more than 6 hrs before the end of your shift.
Steveieboy actually has a very good way of describing it by first splitting into the 6 hrs rule and then assessing how long or how many 15 min breaks you need.
The easiest way around it - is to take a 15 minute break in the first 6 hours of duty, (if you drive less than 4hrs during that period works best)
then take another 30 minutes break during the 6-9 hour into shift mark, which clears you down for a further 4.5hrs driving (you’ve now had your full '45) - and it doesn’t hurt to then take another 15 minute break during the spot 9-12 hours into the duty, and a further 15-30 minute break once over 12 hours on shift, as required.
Don’t leave it until 5hrs 55m to take that 15 minute break though, as I’ve made that mistake, only to have some sap buggering about parking in front of me as I’m waiting to park - putting me over by minutes, and getting me that infringement…
I’ll not make the mistake of expecting others to get the f’‘’ out of my way in time any more.

If you have worked more than 6 hours (total) and only have a 15 clocked up, you can’t just finish the shift. Strangely you could have potentially worked on for a considerable time though. Go figure…
Cooper1203, at the point of receiving the text (if before you have put your card in), this infringement was still fixable. Put your card in, record 15 minutes break after you ejected the night before and then say 15 minutes of work after that (for downloading, signing out, handing keys in). Bob’s your uncle, redownload the card and infringement no more.

It’s because it’s extremely flexible, which is an often critique of the EU regulations that they are not. But with that it means you might be in the situation where you can’t finish a shift until you’ve had further break
