On Tuesday he starts at 2 am and works for 10 hours excluding breaks
On Wednesday he starts at 1 am and works for 10 hours excluding breaks
On Thursday he starts at 12 am and works for 10 hours excluding breaks
On Friday he starts at 12 am and works for 10 hours excluding breaks

There driver as had a full 45 hour rest before he started this shift

The driver is an agency driver and as no opt out for WTD in place for this weeks work
The driver takes all rest as EU regs state

What as he done wrong if anything and why

This is assuming that on each shift the driver started working at the beginning of the shift :wink:

On 1 occasion (Tuesday) he’s done more than 10 hours working time in the 24 hour period from the start of shift, as the driver is working nights and has no opt out agreement in place he’s subject to the night time working regulations :stuck_out_tongue: :wink: :smiley:

By 12 am I assume you mean mid-day and not mid-night, however if by 12 am you do mean mid-night then the driver has gone over 10 hours working time in the 24 hour period from start of shift on 2 occasions :wink:
