WTD question

If I exceed my limit on working hours within the reference period I need to take time off but not paid leave, does this mean I can’t do any work of any kind?
Hopefully this will just be hypothetical but I’d like to know.

LEGALLY you cannot do any more EU regs work but as no authority seems to be bothered then its up to you and your boss what you do

Legally you cannot work not under EU regs because that is under the RTD rules but you can under the normal WTD rules and the two sets do not get added together

You could do anything under the WTD from flipping burgers to driving LGVs doing UK domestic work

WTD = normal workers rules
RTD or RT(WT)R = for those under EU regs

Your dcpc trainer was probably referring to EU regs work

The two sorts of WTD makes it confusing for some especially those who do not realise that the RTD and WTD are two completely separate regs which are not added together

The normal WTD has no legally required rules like the RTD

Although doing work under WTD can be counted as other work for the EU tacho regs it does not count as work under the RTD so that is another thing some get mixed up with
TACHO regs and RTD regs are again, two separate sets of regs

Little example to show how it all works …

Shift under EU regs from 6am to 4pm = 9 hours of driving and other work for RTD (1 hour break taken with no POA)

shift at MacDonalds from 5pm to 9pm = 4 hours for normal WTD + counts as 4 hours other work for TACHO regs plus 0 for RTD

Rest for EU regs = 9 hours = reduced daily rest

Totals for that 24 hours…
9 hours RTD
4 hours WTD
9 hours TACHO REST

So anytime I spend in the warehouse counts as other work on the tacho, but not in RTD. If so I have absolutely no concerns.

Working in the warehouse for a whole shift would be under WTD not RTD

Doing a part of shift in the warehouse with some driving on tacho would all be RTD
