WTD Question

Morning all,

Quick WTD question,

If I have a day of hard duties that starts at 7am, I take 15mins break 11:15 - 11:30am. How long could I continue to work before my next break is due?

Should be having another 15 minute break before 1600 when your shift exceeds 9hrs assuming you’re not driving?

6 hours so 17:30. Just remember that you’ll need another 15 before finishing your shift as you’ll have worked over 9 hours.

When you say hard duties, does this include driving ?

One of the biggest myths of the WTD is that you need 30 mins by 9 hours. OP please disregard this.

Yeah I always forget that only 6hour rule applies before end of shift. Bare in mind however you can’t end the shift on your break either.

AS said 15 mins to start by 1730 unless you need a driving time break before that of 30 mins

Nothing wrong with finishing a shift on a break, it just won’t count towards the wtd that’s all

There’s 2 parts to the wtd breaks.

  1. The 6 hour rule
you can’t work more than 6 hours at any point without a 15 min break, a break of 15 or more allows you to work upto another 6 hours before needing another 15 min break. This works the same as driving 4.5 hours and a 45. (Only driving and other work count as working time)

  2. The total break
This is dependent on the amount of working time in the shift, only driving and other work count as working time for the wtd.

0-6 hours of working time = 0 break required
Over 6 but not over 9 = 30 mins of break/s
Over 9 = 45 mins of break/s required.
A shift can only be have 1 of the 3 apply, so ignore the other 2

Breaks can be taken anywhere in the shift to count towards the total required, except the very beginning or end of the shift, so each break must have at least 1 min of work either side of it and they must be at least 15 mins long to count.

So anyone who drives over 4.5 hours in a shift will have a 45 for that and tick the total break box for any shift, so all they’ll need to worry about is the 6 hour rule.

This is the extreme example of what is legal

Work 6
Break 15
Work 6
Break 15
Work 2:14
Break 15
Work 1 min

As long as the driving time is not over 4.5 hours

Can’t be…

Many, if any industries that think it’s acceptable to allow their workforce to labour for up to 12 hours with only 15 minutes off.

It’s bang on, no one is saying that what you must or should do, but that is what you’re allowed to do.

Before the wtd came in that a lot / maybe most drivers seem to despise, then no breaks were required at all by a driver that didn’t do more than 4:30 driving in a shift.

But I say most of the drivers who do have a problem with it don’t understand it correctly and believe in all sorts of made up rules that don’t exist around it, as it’s not actually that restrictive that they make out
