WTD Query on Breaks for Night Workers

I read the drivershoursgoods.pdf document posted from the DFT’s website and it states that night workers working between 6-9 hours should have a break or breaks of at least 30 mins, or 45 mins if working 9 hours or more.

I do night trunking and a guy reckoned i can’t have 15 mins on the way down and then 30 mins after 4.5 hrs driving.

Usually i pick up the wagon all hitched up and ready to go, so i have no “working time” as such, just driving for 2.5 hrs then have 15 min break, drive for another 2 hrs and have a 30 min break for my driving time.

Then i changeover [10 mins of work] and begin my next 4.5 hr driving peroid. I usually drive 3 hrs, have 1 hr POA, 0.5 hr working [tipping load] then 1 hr driving time to return to base.

This is regular and “driving time / other work” usually total just over 9 hrs.

As i’ve already had 45 min break for my driving time am i having correct breaks / rest periods for the shift i’m doing or should i be having additional breaks.

That’s not just night drivers, that applies to all drivers who fall under the WTD regulations.
