WTD & POA

Morning chaps and chapesses.
I would lime to know if someone could clarify a grey area for me.
I have been told that if my 6 hr rule starts from say 6am to 12 pm and i have Poa in between for say for 30 mins then i can move the 6hr rule to 12.30 or move depending on duration of poa as long as i don’t go over 4.30 drive. Is this correct.

Many Thanks

Yes it is correct, the rules say you should not do more than 6 hours working time before having a 15 minute break, POA doesn’t count as working time.

Thank you very much for the reply and info.

Poa freezes time im told! :unamused: :unamused:

But even a donkey has to have a carrot!

So just take a break ! :unamused: :unamused: :unamused: nuff said.

what if you can only stick it on POA for ten minutes, there’s no point sticking it on break for that.

also is there any rule on how long a period of POA has to be (like 15/30 or 45) or is it just how ever long it is will extend your 6 hours working by how ever long you’ve had on POA

If the shift was over 9 hours working time, for the RT(WT)R you would need to have another 15 minute break at 16:35, that’s 6 hours from the end of the last break.
That is of course unless you needed a driving break first.

This may help…

Example - no POA used in this 15 hour shift
Start at 0600
Break 15 mins at 1030
Driving time reaches 4.5 hours at 1330 so 30 min break taken - the RTD now has the required 45 and the driving time 4.5 is reset
Finish at 2100 without taking another break = OOPS because from 1400 to 2100 is 7 hours with no break
The driver would need another 15 mins to start no later than 2000 to comply with the RTD 6 hour break rule even though the full 45 to cover a shift over 9 hours working time has already been taken

I should’ve POA’d all my drops yesterday…

I always thought that I would’ve needed to take 45 within the first 6 hours of my shift so in regards to the example you gave I’d have always taken a 15/30 or a 45 before 1200

Dunno where you got that idea

No driver to do more than 6 hours in a shift without a break of at least 15 mins

Now we come to a choice so choose only one …
Total work time in a shift is between 6 and 9 hours so breaks totalling 30 mins must be taken
OR
Total work in a shift is over 9 hours so breaks totalling 45 mins must be taken

my shifts 99% of the time will go over 9 hours.

In trying to make sense from what you’ve said I can start work at 0600 take a 15 before 1200 then work for another 3 hours before I’d have to take a 30, assuming I haven’t hit my 4.5 driving.

Sorry i may be coming across basic but I’ve never been shown anything with a tacho or ever been taught anything to do with hours properly

There’s no legal requirement to take that half hour if you are going past the 9 hr mark.
But you would need it before you finish or before exceeding another 6 hrs of work.

All this assuming you don’t do your 4.5 hrs of driving.

ok so I could start at 0600 take 15 at 1159 then work until 1814 which is when I’d need to take a 30? obviously wouldn’t cut it so fine

Breaks only need to be 15 minutes long so you could have a 15 at 12:00 then another at 18:15. You’ve now worked over 9 hours so you would need another 15 before your shift ends but there is no requirement for that break at 18:15 to be 30 minutes.

ok so going by that I can have 3x15’s in a 15 hour shift, providing I don’t need to take a longer break for driving hours

Choose one of the options not both
You either have shift containing more than 9 hours of WORK or you don’t
WORK is the total of driving + other work done in that shift
