WTD - Part Time Driver, Part Time Admin Asst.....?

This might be a bit more obscure, but here’s one for you…

Say i’m driving a lorry/other work associated with unloading lorry, and do a night shift and don’t finish until 6am…

Am I able to have a snooze & a shower (and alot of coffee) and go off to do some office work (admin temping, hey its money) that same day (say 10am - 4pm) if it turns up, and I know that I haven’t got any work for next 2 days after that??

OR

The other one that looks like it will crop up next week - have an agency shift on Thursday 8 - 4pm, nothing driving on Fri - am I going to be shot for going to work in the chippy on Thursday night from about 6 - 12?

No you can’t, you need at least 9 hours between finishing at 06:00 and resuming any other work.

Yes you may well be shot, same reason as above.

you wont get shot for the chippy bit but you will breach the drivers hours as you wont have had at least a 9 hour break (allowed 3 times a week) before the end of the 24 hours from when you started.

as for the other job that is a no no as yet again no break long enough prior to completion of 24 hour period

Up to you… but you have a LEGAL requirement to record any other work you do that week on a seperate tacho where you come under EU LGV regs between Sun midnight to Sun midnight.
If you are getting cash-in-hand for the chippy then there is no record of you working there for anyone to see but being in a public place might be your downfall…

you are to record any other work that is carried out on the back of blank charts for the whole week if you are involved in any inscope drivng work at all during that week. if you dont do any inscope dfriving you dont need to record it.

i think it is just to ensure you are keeping within the law and breaks and all that mumbo jumbo minefield that is drivers hours and the WTD

I am fully legit with chippy, and think they’d rather keep me on, even if on restricted hours, so maybe need to have a chat with them so that they understand if I tell them I can’t work past what-ever-time on a Friday night (hey I guess there could be compensations for the old social life!)…

So - the acid test is:

Can I get 9 hours uninterrupted rest in before 24 hours after the start time of my earliest work of each day?

Just spoken to boss to ask if its ok that I finish 15 mins early on Thurs and he was better about it than anticipated…hopefully that doesn’t mean am about to get sacked anyway - would have to start paying for my fish suppers then…(though contracting waist line might work well alongside new more sociable hours!)

“A driver may reduce his daily rest period to no less than 9 continuous hours, but this can be done no more than three times between any two weekly rest periods, and no compensation for the reduction is required. A daily rest that is less than 11 hours but at least 9 hours long is called a reduced daily rest period.” (GVG262 P16)

Er, devil is in the detail, but you can take up to 3 reduced daily rest periods of 9hrs between weekly rest periods. (So the possibility exists that more than three 9h reduced daily rests could be taken in a fixed week.)

The two days you can do ten hours driving, on the other hand, are part of the fixed week. (I think)

Daily rest can be reduced to no less than 9 hours 3 times between two weekly rest periods.

Driving time can be extended to 10 hours no more than twice during the week (00:00 Monday to 24:00 Sunday).
