Presumably you’re referring to the 10 hour night working limit in which case the answer is No you’d have the union on your back and in any case the company would be unlikely to agree to it, unless of course the union agree to come to a separate agreement for you but that would only happen if you do a different type of job to the other drivers and there were particular reasons for you not sticking to the 10 hour night time working limit.

The reply above is on the assumption that you’re subject to the collective agreement that’s in place, in other words you’re a member of the union that made the agreement or you’re subject to the same terms as the union members.

I was under the impression from reading the regs that no one individual can opt out and it must be a collective agreement - am I reading it wrong :question: :question:

i think you will find that its all the employees and there union in the company that have opted not to work more than ten hours

You work for Asda don’t you? Plenty of option for POA and breaks on that job so you should still be able to get a 13 or so hour shift in. :wink: :smiley:
