WTD ~ first early start

tomorrow will be my first early start under the WTD. i have to start at 0230 to get to destinaton for 0500.

now my understanding is that as there is no agreement between myself and my employer, i can only work a 10hr shift, so including a 45min break, i will have to park up at 1315. i can see me having problems with the office about this, so i would appreciate some feedback so i know exactly where i stand.
could the agreement be verbal or does it have to be written?
is it an individual agreement, or do all affected employees have to agree to it?

You’ve interpreted it wrong. It is actually 10 hours WORKING time, not duty time. REmember that all hours quoted in the WTD refer to working time EXCLUDING breaks and PoAs - in other words it only includes driving time and related duties which would be indicated by other work on your chart.

So you could still do a 15 hour day if you had 5 hours worth of breaks and PoAs

At Geopost I used ot start at 7pm and drive to Birmingham. I’d be fuelled up and parked up by 10pm. I would then sit in the canteen watching telly until my return trailer was ready at 3am. I’d then drive back to my depot and sit there until it was unloaded and park back up at 7am. As far as the working time directive is concerned, the time sat watching telly at the hub is a PoA so only 7 hours of a 12 hour night shift counted as working time.
