WTD - Can a company opt out?

Can a company opt out of the old 10 hour night shift rule, the 17/26 week average and the maximum 60 hour working week limit??

Can you get fined from vosa for WTD.

The drivers of a company can choose to opt-out of the 10hr night rule but the management can’t be involved in the decision at all.

The company cannot opt out of the 48hr rule nor the 60hr limit. However remember that only working hours (driving/other work) count towards these hours and not breaks or PoA.

VOSA don’t seem to actively enforce the directive even though they are the body charged with doing so.

Have to disagree, they took a great interest in my compliance or otherwise with it during their site visit and wanted to see proof of it, Section E on the form below.

They may not appear to enforce it during roadside stops but if they suspect, following routine questioning, that a driver’s employer is not overly concerned about it, then you can guarantee that the Operator will receive a visit, during which “advice” will be given. :wink:
