cooper1203:
sorry to rehash an old thread but a little bit of an update…
I have noticed that although i still keep getting these messages about wtd breaks (had one the other night aboit working so many hours in 24 hours (less than 15) and a few more regarding the 10hour rule) I have noticed i only get them in one perticular vehicle although the others that they have are also 22 plates and im fairly sure the same tacho head.
I’m not bothered about wtd , infringements , I’m more interested in how’s the reversing going ?
Ws it because the break registered cannot be used as break towards the end of your shift, has to be taken during the shift and not towards or at the end. I sometimes got these infringements because of this.

WTD Breaks cannot be taken at the end of the shift, but you certainly can take them towards the end. As long as there is at least one minute of work recorded between Break and shift end, they still count.
Bizarrely, if your day involves a fair amount of Work but less than 4.5 hours of driving, you can get to the end of your shift but not (legally) be able to knock off and go home until you have had another 15 minutes Break and done another minute or two of Work. This is where manual entries made at the start of your next shift can be useful…

Goes to show how little we really know about EU driving hours and WTD breaks etc. I know enough to get through my normal day on what I know but could easily break some rule that I am unaware of. I find it bizarre that you can take a WTD break 1 min before the end of your shift. In respect that you have to sit for 15 mins before you remove your card and it counts. I have had WTD infringements in the past that I didnt know I had commited. Probably from the above example. So complicated to most but some maybe not so much. We have too many things to consider and abide by as drivers in my opinion.
I imagine the WTD/RTD will be high on the Tory’s list of retained legislation to be dispensed with. TBH the only infringements I tend to see with my drivers is: failing to take a break before 6 hours work, apart from that it’s never an issue.
Look lads these hours are not there to make you work right up to ,come on now 6 hours before a cup tea and a bit read, it is 2022 , the WTD is a silly set of rules and should be binned ,the driver hours need to be reviewed and brought into line with other groups of workers , I have never been anywhere near 6 hours without a rest I can not imagine any other group of workers putting up with it

I’ve worked in hospitality and farming, there’s 2 groups for you right there that will regularly go significantly longer than 6 hours without a break. I’m not saying it’s right or anything, just countering other groups not putting up with it.
And don’t shops often do 6 hour shifts so that they don’t need breaks?

The silly WTD does not effect me as soon as it mentioned 6 bloody hours before a rest, no take no notice of crap like that
It doesn’t say you must work 6 hours before a break , it’s just that that is the maximum before you must take a break as opposed an entitlement after 6 hours to a break for the majority of workers in the country.
I know it does not say that ,it is the fact that people on here are treating it as part of the normal day, and I think it is a disgrace to set it up as it is" ok we said it was" the only discussion should be when is the silly stupid thing and the POA going to be binned.

So just to check I’ve got this right?
You don’t like that the WTD allows upto 6 hours of working time between breaks, so because of this you want it abolished, so that we don’t need any breaks at all if we don’t do more than 4.5 hours of driving.
No steve your way off the mark if you were to read most of my posts it is the fact that I think the driver hours are to long and are stuck in the dark ages…the hours are a true reflection on h&s I want the WTD and the POA binned…poa what is it for so you can extend your working day key word here it availability if you are available then your working I really can not see how you think I want a free for all on hours …

Poa is just a tool for the minority of drivers that get all recorded breaks deducted to get paid whilst waiting around and not unnecessarily racking up wtd working time.
I don’t use poa as it’s pretty much no use to me, same goes for most drivers I’d say, so if you ban it the only drivers it effects are the minority that have all recorded breaks deducted.
Poa doesn’t extend your day, you are governed by the EU regs daily rest requirements, which allows 13/15 hours for the shift
You are limited to 60 hours of working time per fixed week and max average of 48 at the end of the reference period, only driving plus other work count as working time.
So you want break more often than the WTD allows, so surely you should be calling for it to be reduced from 6 hours and not banned as banning it allows 15 hour shifts with no breaks if not more than 4.5 hours of driving.
If you’re available to work, but you’re not working, then surely you’re not working? Ie asleep on the bed or on facey or tiktok.
Because you want the WTD banned, which means you’re required to take less breaks or no breaks if you don’t drive more than 4.5
