Our company have not opted out of the WTD for the night working rule so if we start before 4am we can only do 10 hours which I know but I want to know say if I stay out on a Friday night and I’m just running into the yard am I allowed to do it?
The reason I ask is because I did it once and was told I couldn’t start before 4am due to us not opting out of the WTD which I thought is bollox as I’m only running into the yard Saturday morning and probably would only be doing 4 hours at most.

Regardless of whether or not you have an opt out you can start (if your tacho permits it) before 4am with no problem. You already know that with no opt out you can not exceed 10 hours working time, but as you are merely running in I shouldn’t imagine that’ll be a problem Steve. Unless you are running in from Barcelona of course!

You’re right it’s nonsense, there’s nothing to stop you starting before 4am if you’re not working more than 10 hours in the 24 hour period.

Does it not say if you start early “regularly” it’s only 10hrs… I would just crack on in your case.

Me it’s unfair you only getting a hour £11 for running in on a Sunday I’ll give you a full day’s work too make it worth your while

Simple remedy Steve, let them stick to their bloody stupid rules it gives them summet to do, whether they are legally relevant or not (who gives a ■■■■ about wtd anyway) and just run back in at One minute past four job sorted.

I don’t bother with it, it’s all b.s.with no real purpose, other than going along with whatever authority’ s attempt, to make things look better to what they actually are.
ie. To look on paper, that we are not doing excessive hours, where in reality we are,… so ■■■■ them.
If I am doing other than driving, breaks, or daily rest, it goes on other work and I get paid…end of.

Oh I do pal but sometimes on a Friday especially if around M25/M1 area around dinner time I’d sooner park up drop a 9 and have a chilled out drive up a deserted motorway at say 00:00 and get back at 04:00 rather than stuck in bumper to bumper traffic

Your transport guy is a clown. Probably went to the same clown college as our transport guy as we are told the same. I ignore it when necessary and never get infringements for just taking a 15 for the 6 hour rule.
But if I’m not in a rush I’ll take 30. I’m paid by the hour and if the company want me sat on my arse for twice as long as is necessary then who am I to argue.
