hi all, a mate of mine is working from 4am till 9 am ish mon to Fri in a supermarket non hgv,can he or can he not have 30 mins break and then go hgv training on the job not for licence as he’s already got it but 12 hours work with second driver non paid until fully trained etc? As he’s sitting in passenger side for half the day then driving hgv for last 6 hours anyone think this is breaking laws? If so what punishment would actually happen

For the tachograph regulations the supermarket work counts as other work so basically he’s doing a shift of over 17 hours every day, of course that’s not legal.
Although he’s not that likely to get caught, if he’s doing that every day for any length of time I imagine a chat with the TC could be on the cards if he did get caught, if he was involved in an accident while he was driving and the length of his working day came to light the [zb] could really hit the fan.
Training is only tachograph exempt if it’s training towards gaining a licence which isn’t the case for your mate.

There was a driver who killed someone because he fell asleep at the wheel, it was found that he had been working one job then moonlighting as a HGV driver. I believe he got done for causing death by dangerous driving. This is a serious offense, the TC and the Police will take your mate to the cleaners if they found out.
To be clear my mate hasn’t started the hgv training yet and I’ll be warning him off the idea until he has left supermarket first
