WTD and Driving time

I’m still learning and I’m told no question is a Stupid question ! … I have a question ..

I started my shift at 6am today WTD start , my driving started about 6.25am , as the day progressed with other duty considerations within 4 1/2 driving time , at 11am I was at a drop and thought it’s getting close to 6 hrs WTD after my start and I’ll need a WTD break thinking I couldn’t find any where to park for my 45 min break where I still had about 1 1/2 hrs drive left so I had 15 minute WTD break . I then carried on driving and within my 4 1/2 driving found services to take my break, I had a break of 45 mins , have I done this right , that’s my question , thinking I’ve had one 15 minute break and then within the hour a 45 minute break ( the 45 break was done within 4 1/2 hour driving time ) my end drive time was 3 ish hours after my 45min break

What you did was fine and legal :slight_smile:

However, as you had done some driving before the first break the 15 min break you had counted as the first part of a split driving break, therefore you could have got away with a 30 minute break at the services if you wanted to.

A split driving break is when you take two driving breaks, the first must be no less than 15 minutes and the second must be no less than 30 minutes, and they must be taken in that order.

You’re right though, the only stupid question is the one you needed an answer to but never asked :wink:

As above break can be split in 2. A 15 and 30.
Long as take your 15 before 6 hours from when you started..
Then you can continue upto 9 hrs from start of shift before having stop again .
This way will also reset your driving time to allow you another 4 half hours.
Or could stop for a full 45 all depends on your situation and what suits you

So with this are you saying for a split break :

starting work at at 6am (WTD) I can take a break at 11am (or any time within driving time ) of 15 mins , then before 3pm being within driving time ( 9 hours from WTD start time ) take a 30 minute break which resets the driving time to a further 4 1/2 hours ( obviously not everyday )

Where appropriate breaks of 15 minutes or more count as both WTD breaks and driving time breaks.

So if you start work at 06:00 then have a 15 minute break after doing some driving it will reset the time for the 6 hour rule and also count as the first part of a split driving break, you will then need another break no later than 6 hours from the end of the first break or before exceeding 41/2 driving time.

For the WTD:

  • You must have a break of at-least 15 minutes before exceeding 6 hours working time from the start of the shift. 6 hour rule

  • You must have a break of st-least 15 minutes before exceeding 6 hours working time from the end of the previous break. 6 hour rule

  • If the total working time in the shift exceeds 6 hours but is not more than 9 hours working time you must have a total of at-least 30 minutes break.

  • If the total working time in the shift exceeds 9 hours working time you must have a total of at-least 45 minutes break.

  • All breaks for the WTD can be taken in segments of no less than 15 minutes each.

  • Where appropriate all breaks count for both the WTD and driving time breaks, they do not have to be taken separately.

As above basically start at 6 you can work untill 12 before need your 1st break then untill 3 or before if you reach 4 half hours driving thenyour need a 30 mins to make it 45.
Then it resets to 6 hours or 4 half hours driving which ever happens first
.
But say you start at 6 work to 7 than take a 15 min break your need your next break at 13 15 as that’s 6 hours working .
