Say i’m going to work a 7.5 hour shift…ok?

Fit a 15 in before the 6 hours is up fine…ok?

Then work till the 7.5 hours is up, pull card and go home, fine…er no, it results in infringement.

Why do we have to show another 15 mins of actual break when we’re on break for 15 or more continuos HOURS.

Hope that makes sense, cos if it does thats more than it does to me.

Assuming that you did more than 6 hours of work in that 7.5 shift then the RTD rules state that any shift in which the work in that shift is more than 6 hours but less than 9 hours must have breaks totalling 30 mins - that 30 mins can be split into 2x 15 mins but cannot be right at the start or end of the shift

Still bloody crackers mind cos after 7.5 i’m off for 15 or more hours on those days, but then these regulation peculiarities have never made much sense.

Thats the case, in your answer you have put it in easy to understand language which hasn’t been the case.

As you probably already know that short sentence ‘‘cannot be right at the start or end of the shift’’ speaks volumes and clarifies it simply for simple buggers like me.

What you’ve done is work for a total of 7h 15m and only taken 15m break.

e.g.

0700-1200 work (5h)
1200-1215 break (15m)
1215-1430 work (2h 15m)

What you should have done, having got the first 15m in before 6 hours were up, is this:

0700-1200 work (5h)
1200-1215 break (15m)
1215-1430 work (2h 15m)
1430-1445 break (15m)
1445-1446 other work. (1m)* the all important “bookend” to the shift which shows the break is not running into the daily rest.

then pull the card. That way, as you’ve now realised, you’ve taken the required 30m for a 6h01m - 9h00m (subdivided into 2 x qualifying 15m blocks) during your shift.
