ok so i understand this rule my question is do all company’s work off the same ref period ie are the dates they make the calcularions the same i only ask as when you start with a company do you slot into there period or would it be the same as your previous employment thanks in advance

Why do you need to know because it is not your job to keep tabs on it
Recent job change and there ref period is up in a cpl of weeks and thee saying we are all to high but i have only been the a cpl of months hence the question re the ref period being fixed date

On subject I was always under the impression that whatever reference period (17 or 26 weeks) was a rolling period?
Yes it’s a rolling period. The length should be chosen by your employer and monitored by them. So long as you get plenty of POA and or break in your days then you should be able to achieve well above the WTD limits.
Don’t think I’ve heard of people getting fined for it. Most decent firms take it seriously, the rest have bigger problems I guess.

When I switched employers earlier this year my new employer started the calculation from the day we joined the company for the remainder of the current reference period. In some cases people joining at the same time as me had been running above the average, in other cases below. No one running above was AFAIK asked to work any less hours, and I certainly wasn’t asked to work more to use the hours available from pre joining days.
DVSA have nothing on their sanctions list for WTD breaches
