Working Time / Driving Time Question

Hi,

Just back from a trip from Scotland to London and back with overnight stay.

on the first leg I was unsure how long I could work for as different drivers I spoke to said different things. Here are my hours.

Started at 8am.
Drove for 1 hour 25 mins
Break 45 mins ++

Drove for 4hr 1 mins
Break for 45 mins ++

Drove for 4 hours 10 mins
Then Stopped for night at 21.40pm

Total driving = 9 hours 36 mins
Total Shift including breaks = 12 hours 40 mins

on the leg back I know I have a problem as I was over my 10 hours by 19 mins. How much bother will I get in for this one off break of hours to get back to base??

I’m not sure why you think you could be over on the first journey, assuming that you had an extended driving shift available for the week, which I assume you had, there’s no problem with 9 hours 36 minutes driving and 12 hours 40 minutes total shift time.

On the return journey you went over your driving time by 19 minutes which could be a possible fine of £100, however as you was fairly close to base where your duty time would end you could get off with it.

0800 to 2140 = 13 hours and 40 mins … yes?

I think he meant that 4 hours and 10 mins driving was done between the last 45 break and the start of the rest period not that a 45 was taken then followed with an unbroken drive of 4+ hours

i was allowed extended driving to 10 hours for those 2 days. The main thing i need clarification on is working hours and the max you are allowed.

You must have a daily rest period of 11 hours completed within 24 hours from the start of the shift, this can be reduced to 9 hours three times between weekly rest periods.

In other words the maximum spread-over from the start of the shift to the end of the shift on a single manned journey is 13 hours, this can be increased to 15 hours three times between weekly rest periods.

I started at 8am on the first day and started my rest at 21.40. I started driving again at 6.40am the next day (9 hours rest). so this is ok?

Yes - you have had a reduced daily rest (max 3 between weekly rests) of 9 hours within 24 hours of 8am and restarting at 6.40 resets the 24 hour clock

You can have three reduced daily rest periods between two weekly rest periods.

In other words when you start work after a weekly rest period you can have three reduced daily rest periods before your next weekly rest period, once you’ve had a weekly rest period you can have another three reduced daily rest periods before the next weekly rest period.

Any two weekly rest periods - any period where 24 hours off has been taken is a weekly rest period (unless it has been reduced to less than 24 because some of it has been used as payback)

The 8 hour rest period used to be the part of a split daily rest period until it was changed in 2007, you could have a split daily rest period in two or three parts one of which had to be at-least 8 hours.

Now a split daily rest is only two parts, one part of 3 hours or more and the last part of at-least 9 hours.

So you’re right you cannot have a daily rest period of 8 hours and haven’t been able to since 2007 :wink:

↑↑↑ Not that it matters but in the old regulations (pre-2007) the daily rest period for multi-manning was also eight hours within the period of 30 hours from the start of the shift.

Forgot about that until I just checked the old regulations :blush:
