working time directive

The working time directive says that,

These rules don’t apply to jobs where the working time is not measured and the worker is in control - eg managing executives with control over their decisions

Does that mean that the working hours limit does not apply to Transport Managers?

Don’t seem to apply to Tm’s or anyone at all from what I can tell

The RT(WT)R applies to mobile workers who work in-scope of EU regulations, a mobile worker is anyone who drives to EU regulations and staff who travel with the vehicle as part of the transport team.

In other words if the TM is always office based he’s not a mobile worker, but if he regularly drives in-scope of EU regulations he is a mobile worker and should comply with the RT(WT)R.

Anyone knows answers to these questions?

If I work less than 6 hrs in a day, what break, if any, should I take?

  1. No break needed to be taken?
  2. 15 mins break?
  3. 30 mins break?

Lets say I started at 6 am, took 15 mins break at 10 am, what time at the latest do I need to finish to not be required to take another break of 15 mins?

  1. Is this at 12 noon
  2. or is this at 12:15 pm?

If you don’t do more than 6 hours working time you don’t need a break for the RT(WT)R.

If you work past 12:15 and do not book any POA or breaks of less than 15 minutes you would require another 15 minutes break to bring the total up-to 30 minutes for a shift of over 6 hours working time, so without POA or short breaks the latest you could work without needing another 15 minute break would be 12:15.
