Hi all
I am a unemployed class 1 driver and would like to ask you Owner driver/self employed out there as you probably know that soon you will have to come under the Working Time Directive(WTD) i would like to ask a few questions about it .
1/ As a Owner Driver / Self Employed do you use the WTD now.
2 / Do you think that when you have to use it you may loose out.
3 / Do you think that it when it come to force for you that you may have to employ some one to make it pay.
4 / Pack it in and work for some one else.
It would be interesting to know how you feel about it

TBH it wont make a diffrence to my operation as i will continue as i am working to the tacho. I know of plenty of companys who pay no attention to this stupid law at the moment so when it comes in for O/DS i will also pay no attention to it. It is virtually unmanageable it is not being enforced and virtually no country in the EU is enforcing it. As for some idiot in brussells to tell me how long i can work to feed my family when i already have a set of rules (tachograph) id say there was human rights issues there

They probably haven’t have been exempt anyway. The definition of a self-employed driver is different for the WTD, as opposed to what HM Revenue and Customs require for example. The main requirement for being classed as self employed to meet the WTD exemption is the self employed driver must have an operator’s licence and their main occupation is transporting passengers or goods by road for hire or reward. Self employed agency drivers won’t have their own O Licence, and if they did they wouldn’t be operating under it working for an agency driving other peoples trucks, they also would not be working for ‘Hire and Reward’. It’s only been Owner Drivers who have been exempt.

As Coffeeholic has said, self employed agency drivers have never been exempt anyway as the definition of self employed for the WTD is different to the normal one.
