Who was at fault?

Totally standard driving for New Cross, from both drivers. The most shocking thing about that video is that the van on the right managed to avoid scraping the car in front when he pulled out of the queue.

Regardless of who’s fault this turned out to be legally speaking, I just can’t get my head around the fact he didn’t even stop accelerating. It’s almost as if the thought process went “Don’t pull out idiot van…Oh you are pulling out…And you shouldn’t be…Well sod you, time you got taught a lesson…” truck driver deliberately lets the crash happen

I’m probably way off, mind, but that’s the impression it leaves.

So the Van driver made a mistake, and is the INITIAL reason for the collision. However the lorry driver needs to take his Hazard Perception test again, if he has at all… As if he had been driving properly, within the speed limit, to the condition and hazards around him, the accident could have been avoided. So I think the lorry driver is the bigger bell end.

Although, if the Lorry driver turns out to be directly employed, and not agency, I reserve the right to reverse my opinion! :smiley:

Despite the wrongdoing of the lorry driver (although the police don’t enforce 20MPH limits in Bristol, implying to me that they are not that important - the speed limit that is), the van driver was only going to block the road for oncoming traffic, typical of a normal selfish clueless London driver IME, so he should be held to blame, mainly. It’s exasperating when people do that for no benefit to themselves. He deliberately put himself in the danger zone by pulling out with an lorry oncoming. (Presuming he was male; wouldn’t mind betting he was foreign too, but now I’m getting prejudiced).

However, either party could have prevented the accident. As stated by m1cks here:- viewtopic.php?f=2&t=125300, the presence of a dashcam seems to me to not exactly encourage driving to prevent an accident where someone else has done something “wrong” and the evidence of their wrongdoing is captured on film so to speak.

It was the van drivers fault. He pulled out in the path of the truck.

Having said that it was obvious from a long way off what the van was about to do so yes the truck should have braked a lot earlier. Would have avoided the accident at the expense of a bit of inconvenience of slowing down a bit.

As for the motorbike crash mentioned. I always though it was harsh to blame the car driver. The biker to me was more at fault because of his extreme speeding. It would have been quite easy to miss a small vehicle coming towards you at nearly 100mph.
But thing when people die, it seems the justice system must find somebody else to blame, even if the truth is the victim caused their own downfall.

To come to the defence of the driver he is an employed driver, not agency and thankfully does not normally have any issues. I think that he must have had a complete brain failure on this particular day as this accident, as confirmed by most of the respondents on this thread was totally avoidable.

Hopefully it will be a lesson in pre-empting other drivers pulling out in front of you and why it is no good to anyone taking an aggressive line as he has proved it can go wrong! In this example it was quite obvious what the van was looking to do so I don’t know why he didn’t manage to stop. As I say I think he had a brain failure on this particular day. Everybody makes mistakes and everybody deserves a second chance but if he were in another very similar accident then I’m not sure if we would be so forgiving!

Well it’s ok to say that he doesn’t normally have any issues, but how do you know that. Maybe his luck just ran out on that particular day.
