who does what

If the company want to discipline an employee for an alleged offence ,is the onus on the company to prove the employee commited that offence and not the employee to prove innocence. no one else witnessed alleged offence but damage was done to a vehcile and some barriers.i.e the company say driver forgot to aplly hand brake and vehcile was found with hand brake in off position, driver says he def put hand brake on. thanks guys

if the trucks hit a barrier and been found with the parking brake off i would say you left it off[ accidents happen]. i would then say if its the 1st time youve done it, you dont smash up trucks everyday then most firms would chalk it down to what it is a accident, if your smashing them up on a regular basis then theyve got a right to have a bit of a go, just my opinion :wink:

Have a search on handbrakes and accidents. there was a case of leyland (iirc)handbrakes falling off on their own and someone took it to court

no i have a friend, (look at other post erf handbrake)
i,m sure that brake was on but may have caught hand brake lever dragging kit out of cab but vechile did not roll till at least 10 minutes after i left it.
