where do i stand

i currently work in a warehouse i have my own forklift licence which i paid for now i asked for a pay rise and gave justified reasons i.e never been off sick always on time paid for mown licence and they refused and also said if i dont use the forklift i will no longer have a job i think that is quite unfair can anyone tell me where i stand if i refuse it doesnt state in my contract forklift operator but it does state and every other reasonable task will be done my licence expires in october and i know i will be told to carry on using it without a valid licence

any advice is muchly appriciated

IANAL but I would say that if you have been driving the forklift truck as part of your duties, then you would be on a very sticky wicket if you suddenly stopped driving it. Realistically I think the most you can hope for is that they pay the cost of licence renewal, and maybe look elsewhere for a better paying job as a forklift truck driver.

I dont think your contract has to say ‘fork lift’ opperator.
If you tell them that your wont drive it because of the payrise issue, they’l just hire someone who will and they’l be plenty.
It says nothing in my contract of employment about working on a railway OR driving a truck (I have to do both sometimes) but if i told them that i didnt want to do either, they would go down the disaplinary route for ‘refusal to work’.
Simple as.
On the other hand, If they expect you to drive the fork after your license has expired then thats a differant ball game.

In the current situation there isnt much chance of a payrise anywhere TBH, I personally would stick it out til October when your forkies licence is due for renewal, and see if they are prepared to pay for your new one, then if not you can legally refuse to drive it.
The fact you paid for your last licence may seem unfair and probably is, but most companies would exploit this, then pay for your refresher when the time comes.

Just put it down to experience, and whilst working keep your eye out for other jobs if you hate it there.

If they try to sack you for refusing to drive the forklift AFTER your licence expires you have a case for unfair dismissal IMO

Also when you had you interview for the job, was one of the reasons they took you on because you had a forklift licence?
Of course if it doesn’t get renewed, then they can’t ask you to drive a forklift, if they do isist and you get fired for refusing then that’s might change things.

Basically you’ve asked for a pay rise it’s been refused, either you have to accept it or try and find something better. If you can’t then you probably getting what your job is worth.

If I refused to renew my HGV licence then I would get the sack, and I don’t think I’d get very far at an industrial tribunal!

Nope, certainly not. My place would just find someone else within the company to do my job and throw me back in the ‘mixer’ or ■■■■ me off down the road.

Unfortunately the above is true, theres plenty of people out there that are waiting for a chance either as HGV or FLT, and employers know this. Not all employers are reasonable either as most of us know to our cost

i can apprictae they refused pay rise obviously the economy isnt great my i got my licence after i started the job and i wasnt using it then my main concern is what happens after october as we already have one flt driver who is using it with a expired licence

If you cut out all the crap and incidentals - like who paid for the licence, who has or has not to drive the FLT etc, and whether you’ve been late or not - it all boils down to one thing…

Do you want the job or not??

If not, jack it in and let someone else have it…
