I think its all down to interpretation mate. Until someone actually gets hauled into court and its proved either way then its down to the driver to work it out as usual.

But in the meantime, the Regulations appear quite clear - the term “working time” is explicitly defined as “the time from beginning to end of work”, which to my mind means the whole of the shift/period of work, not just the bit that has already been worked.
