Where did he get this from?

we started work at 6am this morning. didn’t start driving until about 0630.
it’s all short distance work.
arrived at loading place at 0715. it opened at 0730, so i had a 15 minutes break.
20 minutes later i’m loaded.
down the road a bit, tipped, then back, loaded again, down the road, tipped.
by now it’s 1pm. and mr experience said “have you had a break”.
“15 minutes earlier on” i said.
“you should have had a full 45 by now” he said.
“what rules are these? EU regs? WTD? or RTD?” i said.
“erm, err, well, you’ve worked over 6 hours, so you should have had a 45 minute break”.
“i’ve no idea what the [zb] you’re talking about mate, i’m going 10 minutes up the road for a wash” i replied.

is he on drugs? or is it me?

If its 6 hours work time then 15 minute break and a if you hit 4 and half hours driving then another 30 mins to make it 45 am sure if i am mistaken i will be corrected.

you’re dead right. but he seems to think that you need a 45 minute break by the time you reach 6 hours duty.
he’s very convinced about it too.
as it happens, i’d done about 4 hours driving.

i just can’t figure out where he got his info from.

He’s talking ■■■■, you have already had a 15 min break at 7:15 for your 6 hours.
I think you should have a 30 min break before 9 hours though or am I talking ■■■■ now?? This all of course if your driving hours don’t exceed 4.5 hours.

Maybe , just maybe, he’s not on about any law. Maybe he’s just a normal guy and thinks hey, we’ve been working since 6am, its now 1pm i reckon we need a break. We done about 6 hours work thats enough ?

Working between 6 and 9 hours per day requires breaks
totalling 30 minutes. If more that 9 hours is worked then
breaks must total 45 minutes. Breaks must be of at least
15 minutes duration.

Where on earth does it say BEFORE or AT

It clearly states BETWEEN

6 hour break would now be at 13.30
9 hour isnt close yet
4.5 hours driving hasnt come yet

45 minute break isnt required yet

Agree except the 9 hour bit
No need to have a break at or before the 9 hour point - its not in the RTD rules

There is a rule to have a total of 30 mins if the work in a shift is between 6 and 9 hours OR a total of 45 mins if the work in a shift is over 9 hours

Work 4 drive 2 - break 15 mins - work 4 drive 2 - break 15 mins - work 1 - break 15 mins - work 1 - go home

For most drivers the driving time breaks will usually cover the RTD rules

In the OP - somebody got all the various rules mixed up

he just wants a break himself cos he is hungry and lazy
and wants to drag the job out

Maybe he’s going the long way round or taking more shunts to get on the bays ? And he’s hit 4 and a half hours driving and thinks your the same lol

i havn’t been on one of them for ages, thankfully.
it takes us 20 minutes to load, and about 10 minutes to tip… usually.
