What's the law on carrying Tacho's?

The VOSA bloke said that even if he isnt out on the road and is working in the yard or on site somewhere he should have a written record of it. even if it is just a diary.

I think the VOSA bloke was being very reasonable in saying that he would settle for a diary of work done on none driving days which is what he probably meant, the entries are supposed to be on charts/printouts or a log book/sheets, this has been discussed on this forum on several occasions :wink:

Recording other work

Drivers must record all other work and periods of availability — including work for other employers — on all driving and non-driving days within a week where they have undertaken driving that comes within the scope of the EU rules on drivers’ hours since their last weekly rest.
For example, a driver who works in a warehouse on Monday, Tuesday and Wednesday and wishes to drive a vehicle within the scope of the EU rules on Thursday of the same week must complete records for Monday, Tuesday and Wednesday.
The record must be either:

written manually on a chart;

written manually on a printout from a digital tachograph;

made by using the manual input facility of a digital tachograph; or

for days where a driver has been subject to the domestic drivers’ hours rules and a record is legally required (see page 25), recorded in a domestic log book.
For the non-driving days, the record may simply show the driver’s name, the date, and the start and finish of the shift. These records must be carried on the vehicle by the driver to be produced to enforcement officers for the relevant period (see individual sections on how to make manual entries).

Before you go getting into any arguments you should be aware the digi card is not your property. Just like your driving licence it is the property of the Secretary of State for Transport, and he is just letting you look after it. :wink: So, best not throw the it belongs to me thing into an argument as you will only be on a loser.

I’ve heard a few drivers in recent months claiming that they would not let anyone download their card because - “It’s my property so they can’t download it 'cause of data protection see.”

this only applies if you use wax charts. if you only use digital then you dont need to carry printouts although you do need to be able to produce them at the roadside hence the requirement to carry a spare roll of paper. if you use both then you need to carry printouts.
the reason for this change was because the digi card holds a months worth of duty so they brought the wax chart users into line with them.

It says to insure you have enough paper to be able to produce printouts there for no requirement to carry a spare roll.

In saying this it’s only advised to carry a spare.

it is since i acquired it from the previous owner :laughing:

i see your point and i wouldnt object to printing the records off providing they dont expect to use my spare roll. whats next? borrowing a pen? how many people say ‘thats my pen not a company pen’ :laughing:

Anytime ive been stoped they just take the card away download it, what is the printer mainly used for, for checking the head for driving without a card etc… ■■? or do they plug their laptop in the tacho head and download it.

Never been stoped in a vehicle that had a digital tachograph, but heard of others where they printed out from the head to check for driving that isnt on the digi card.

vosa can use a control card that downloads the data on the head unite, and then there put the card in to a hand held smart card reader and it displays all the data to them and then there put you card in to see if it tallies up for you if not expect a graduated fixed penalty notice for something, if there find something wrong there will take a printout and get you to sign it

Correct, but the point of carrying a spare roll is to ensure you have enough paper to be able to produce printouts for 28 days.
How many printouts have come off that roll?
Maybe you are the only person who ever drives your truck. Few of us are in that position, did any other driver take a printout?
So, if you don’t have a spare roll, because it doesn’t say you have to in the reg’s, you’re an idiot.
