The company I work for is coming to the end of a 26 week reference period next Sunday there’s around six of us who are averaging around 48.5 hours work wtd. Management don’t seem to want to know . What if anything should we do? Any help much appreciated
you cease driving as far as i am aware or reduce hours accordingly to get back to the 48 average.
Nah, let company manage it, it’ll be them that’s in trouble since they’re the ones tasked with managing your WTD unless you’re self employed
If you’re salaried insist on complying with the regulations and have a bit of time off on full pay, if you’re hourly paid let your employer manage the hours while you continue earning money.

In that case if you’re salaried for 48hrs point it out that you’re currently above the 48hrs for the WTD and you need to reduce next week down to no more than 35hrs to get the average down.
48.5hr average means by Sunday if you do 48.5hrs this week as you’ll have done 25 weeks going 0.5hrs a week average over you’ll have done an additional 12.5hrs (25 x 0.5) so you need to do 12.5hrs less than 48 next week to bring down the total average to 48. So next week as long as you don’t work more than 35hrs your average for the reference period will be 48hrs. The more you work over 48hrs this week the less you can do next week but the more hours less than 48 you do the more you can work next week. A good balance would be two 40hr weeks if you’ve not already gone over that this week.
I would point out to them today/tomorrow where you are for the WTD and that you can only legally work 35hrs next week. And next week you do up to that 35hrs or to the point you can’t do another days work without exceeding it. That night when you get back to the yard and they give you the following days work remind them you can’t because you’ve done the maximum 1248hrs you’re allowed to work in 26 weeks so can’t work again until the following Monday. And also point out if they get funny that as your salary is based on 48hr weeks you don’t expect them to deduct any money either for the days you’re not working and no you can’t use holiday because that is classed as working for the purposes of the WTD.

I would imagine the insurance would be void, if it where a non fault accident claiming for compensation would be difficult.
A good firm would monitor drivers W.T.D hours the same way it should monitor tachograph infringements, if they are using Tachomaster there is a smartphone app
for the driver to monitor his own hours including W.T.D
Oh they monitor and pull us up for infringements very fast! This seems to have slipped their gaze !

Ask to view your card downloads, generally the W.T.D hours are below nearly all drivers estimates.
