Evening surrounding, i am just after anther point a view . Last week at work in our yard i was backing on to one of the bays on my good side, the cab was at about 120 degree angle to get around the other truck on the bay next to me and so to avoid the trailers parked opposite, when out of the corner of my eye i saw a high vis yellow colour, in a split second i glanced to my left to make sure i wasn’t going to run some one over then back and in this time i had knocked the wing mirror on anther one of our lorries parked on the bay to my right.
The knock had coursed the clips on the plastic covers to brake and the covers to fall off (DAF CF) the covers hadn’t cracked and the arm wasn’t bent. I reported this to the traffic office .
After a mountain of paper work my manager concluded its a blameworthy RTA … and i should be more aware of my surrounding area, to be fair if i hadn’t been aware of my surrounding area i wouldn’t have noticed the person walking around my lorry whilst i was reversing.
So the point .
I hold my hands up i knocked the mirror and broke the casing off and i’m not disputing this but would you class it as an RTA.
Even though i’ve worked here for 3 years and this is my first knock (2.5 years agency) i’m still on 6 months probation and whilst i’m sure it wont go against me to much, at the same time i don’t want to be lumped in to the same category as the bloke that hits a car or has a crash… i need to sign this paper work to say i agree or disagree with his decision, then i need anther driving assessment and “counselling”.
An RTA is a road traffic accident. you were in the yard! 30% of accidents happen whilst reversing in the yard! next time flatten the TM with his hi viz on, then they’re will be no mountain of paperwork to fill out!
so who was the Twonk that walked behind you … and you were still going backwards while you were looking for them thats the worse part of it as if you saw and stopped you wouldn’t have hit anything.
oh and its not an RTA if your not on the road its an incident … or a collision

S170 Road Traffic Act 1988 (which is the bit of legislation that essentially defines a “Road Traffic Accident”) was changed many moons ago to also include “public places” which are not roads (e.g. car parks). Wouldn’t include a private yard though.
You might get an improvement notice, no big deal but be careful for the 6 months or so it lasts.
Mirrors aint wot they used to be, if the securing clips on the mirror back plate are damaged it might end up with a whole new mirror @ £££s, and if the lorries are on full R/M lease then thats likely, as the agency will have found out when mine had a complete double mirror assembly fitted when one of the lads ■■■■■■■ the casing.
Half wit pedestrians and the like are one the main reasons i open the door and lean out to reverse in on my own side, they’re Darwin award candidates of course but it’s us in the dock if we crush one.

God I hope Hammy doesn’t come across this thread. Going by what he classes as a near miss he’d have had a full forensic CSI team out and had the yard shut for three days at least,then took a week off for councilling

this is my line of thinking, having an RTA on my record is a little strong for a wing mirror cover, the outfit have lots of red lorrys .

If it’s the company I’m thinking of it sounds like a second class outfit, perhaps they’re stamping down on drivers
Problem is the bigger the company the worse they are. They should think more of you for reporting it, I know some drivers would have kept quiet.

Er - No. You said it’s not an RTA if you’re not on the road. My point was that this is simply no longer true, and many collisions that occur off road are legally classed as Road Traffic Accidents (by virtue of S170 Road Traffic Act), and so are subject to all the requirements to stop/exchange particulars/report to police etc.

Yes, this, just say something along the lines of “I accept that the incident was due to my misjudgement and I have put procedures in place to prevent a re-occurrence happening in the future”. Nothing else. That’s what they want to hear so that’s what you need to say.
