What do I do? FERRY CANCELLED

Can someone help me out here started work at 18:00 the other day other work for 1 hour and then drove for half an hour to the ferry port on arrival I was told the 20:30 ferry was cancelled and the next ferry left at 02:20 so I put my tacho on break for 5 hours 40 mins is this right or should I have put it on P.O.A or ferry mode? Drove onto the ferry and had over 3 hours on ferry mode. I departed the ferry at 06:10 at 09:00 I was parked up and took 11hrs off as I had already used my 3 reduced rests this week. What should I have done in this situation and could I have drove back to my depot? Which was 4 hours and 45 mins away? I know in future to check that the ferry I am booked on is sailing so I’ll phone and check before I start work any help on this matter would be really appreciated.

Did you have access to a berth in the ferry?

If yes, the 5h40 when you were waiting should have been on break. When you drove onto the ferry you should have put it on break again and selected ferry mode. You then should have driven off, you should have parked up, selected break again and waiting until your total accumulated break totalled 11 hours. You could then have done a full days driving.

If no, then what you did was correct, except that you only needed a 9 hour break at the end of the shift which wouldn’t have classed as a reduced as you had already had 3 hours earlier in the shift.

Thanks for help I have a room with a bed in on the ferry it get’s a bit confusing for me sometimes but want to make sure I’m not breaking the law thank’s for taking the time to look at this for me. Appreciate it

There is no such thing as ferry mode as such. Ferry mode is used to interrupt a daily rest to embark/disembark the ferry. It must be a regular 11 hour rest and the total interruption must be no longer than 1 hour. You didn’t need it in this case as you weren’t taking your daily rest on the ferry.

It would’ve been impossible to take 11 hours off in this instance as you started at 18:00 and finished at 09:00. This only leaves 9 hours left to fit into the 24 hour window starting from 18:00 when you started your shift.

Dont panic though, you can class it as a split daily rest as you had over 3 hours waiting for the ferry so it’s not all bad luck :grimacing:

As has been said, you took a split rest of 5h 40m during your shift and 9h within the 24h period from the end of your last rest period. Nothing wrong there. A basic split rest is a minimum of 3h followed by a minimum of 9 hours - within the 24 hour period from the end of the last rest period.

You didn’t need to use the ferry setting as you weren’t interrupting your rest to embark or disembark. The ferry setting isn’t for the period whilst you are on the ferry. it should be selected just before you interrupt your rest and simply marks the data. Same if you interrupt it a second time.
