One of our drivers got dismissed a while back because he drove for an agency whilst on holiday, so how do you go for an assessment without your current employer knowing, the only way would be to ‘Not put your card in’
Why shouldn’t she drive for an agency while on holiday? It’s her holiday to do what she likes with. It shouldn’t even impact on her WTD hours, since statutory holiday days count as working time.
Correct me if i’m wrong but going for an assessment isn’t hire & reward (As you’re not being paid for it) therefore you don’t come into taco regs or RTD. So don’t put your card in.
All EU driving regs work counts for the RTD whether for main employer or for agency
RTD hours cannot be counted twice for the same day so if on holls from one employer but working for another on the same day then only the work done for the second employer will count for that day and not the holls

Main employer holls for 5 days mon to fri = 48 hours for RTD
But then the driver works 10 hours on tue for agency = 4x8=32 + 1x10 = total 42 for RTD
If they worked 10 hours sat for agency in the same week they had mon to fri holls then its 5x8=40 + 1x10 = total 50 for RTD

That’s an interesting take on the job!
This is what I was thinking, as when I was a bus driver many moons ago the fitters and shunters didn’t even require a licence as long as there where not in service (pretty sure that’s changed now) let alone being covered by drivers hours.

Unless there is something in your employment contract that says you cannot drive for anyone else and the driving you did has no effect on what you do for your current employer then you need to tell them … nothing
If the assessment is classed as commercial driving (I think it is) then that is likely to have an effect on the RTD
You are legally obliged to inform your employer of work done for anyone else so that RTD records can be kept legal
If your current employer has given you 48 hours for the RTD for the week off and you inform them you did say a 1 hour drive under EU regs then the days off count as 8 hours each and not 48 for the week
That might work to both you and your employers advantage because 5 days holls would be 48 hours RTD but 5 x 8 hours = 40 hours for RTD
If the 1 hour assessment was during a holls day then that day would be 1 hour and not 8 for RTD

I agree. A 1 hour assessment still counts as working time no matter whether he/she was getting paid or not. If they had a weeks holiday and did an hour assessment their weeks rtd working time calc would be 33 hours instead of 48 for a full week. But he/she may need another days holiday depending on how his/her previous holidays have been calculated, ie whether using statutory or non statutory holidays previously.

Rog is correct. They count Monday to Friday as a 48 hour week for WTD (on holiday) but individual days are counted as 8 hour days
I may be corrected but i believe that this only applies to Monday to Friday so if you work Sunday to Thursday then that is only 40 hours. I may be wrong on that though. It may apply to any block of 5 consecutive days now since they usually modify rules to compensate for initial ■■■■ ups

I had to use the card on the assessment - no card, no assessment. It’s amazing what a can of worms this opens for a simple interview, that we used to be able to do on analogue, then lose the disc. Surely no other industry has to put up with this. Maybe I should go to courts and claim that my right to privacy has been breached, and I have an unfair disadvantage in my search for alternative employment
