just a quick question on weekly rest weekend just gone i had 42 hours,weekend before i had 45hours 15 mins so if i take a 45 this weekend do i still need 45 + 3 the weekend after.

Not necessarily next week end.You have until the end of the third week following the reduction to repay those three hours back so as you reduced week ending 26th April, you have until midnight on the 17th May to compensate.

One thought though, as it is only 3 hours to compensate for, have you not had a 12 hour daily rest period this week, or can you have one sometime soon? You can pay back the reduced weekly rest by attaching it, in one block, to a 9 hour daily rest period.

Several things here, so I’ll address them one by one.

In any two weeks you must have either two regular rest periods, 45 hours minimum, or one regular and one reduced, 24 hours minimum, so at least every second week must be at least 45 hours.

No, you must have made it up before the end of the third week following the reduction. so reduce in week 1 and the end of the third week following week 1 is week 4.

No, I didn’t mean that. Your weekly rest period can begin in one week and end in another, finish 09:00 Saturday and 45 hours weekly rest until 06:00 Monday is fine.

What I was saying is any compensation must be paid back before the end of the third week following the reduction and the end of the week is midnight Sunday.

So, while a weekly rest can start in one week and end in the next it is different when you are paying back reduced hours. In your case if you were adding your 3 hours onto a 45 hour weekly rest, therefore taking a 48 hour weekly rest, those 48 hours would have to be completed by midnight on the Sunday at the end of week 4. If they go beyond midnight of that week you aren’t completing the compensation in the required time frame.

How long are your daily rest periods usually? if you get a daily rest period of 12 hours any time soon that will be those 3 hours compensated for and you don’t need to worry about adding them to a weekly rest.
