Hi everyone, hoping for some help here, I got stuck on M62 on my way home last night so I had to stay out for my fifth night, I ran in this morning and removed my card at 0730,
My problem is I have to be in Pembroke tomorrow night so does this mean I can start my shift at 0730 tomorrow morning if so would I have to make sure I paid back the 21 hours by week three, in affect have to have a 69 hour break by week three,
Any help on this matter would be appreciated

Paid back in full in one go before sunday midnight of the third week following the reduction so as this reduction is in week 1 then by the end of week 4
This will be ok if you had a regular 45 for last week
assuming you did have a 45 for the previous week then you could do this -
week 1 - 24 off with 21 to payback
week 2 - 45 off
week 3 - 60 off - reduced of 39 + payback of 21 with new payback of 6 before end of week 6
week 4 - 45 off
Thanks Rog, you certainly know your stuff, this is my first week back after a fortnight holiday so no problem with the hours there, I should be finished early on Friday so I will pay back the hours next weekend, once again thanks for your help Rog

If you started back on your first day after midnight on sunday then the last 45 hours of your holiday counts as a regular weekly rest for that first week back

So does that mean the two weeks I was on holiday count as 80 hours for the working time directive, I’m not sure if I have to count my first four weeks holiday as working time @ 40 hours per week then the five public holidays I don’t include them in my wtd, I may have that all wrong but that’s the way I have been counting it

Holidays can not be used to compensate for exess hours.
The first 20 days of holls count for the WTD at either 8 hours per day or if the complete week is taken off then that week counts as 40 (edit - should be 48 not 40) hours
Not the responsibility of the driver to keep track of that
Authorities have never seemed bothered with WTD
What is important is the EU driver regs so concentrate on those

It’s not your problem, it’s your TMs problem. They should ensure that you are able to take the required breaks and be able to get to destinations on time.
Don’t start thinking you’ll get yer ■■■■ kicked for lateness when you have to take a certain number of hours off.

In regards to the WTD - it is the drivers responsibility to give the info to the TM but then it is the TMs responsibility to ensure that legalities are conformed to
This is because drivers are not expected to maths experts or to have computer systems to work it out
Reduce to a 24 hour rest followed by a full 45hr rest every week until you next go on holiday.
24 - 21 owed by 3rd week

Next holiday you come back slate wiped clean and start again with no compensation owed.

I agree with you…
It is the drivers own responsibility to ensure the hours rules are adhered to.
What I’m trying to point out (and failing badly) is no one should feel pressured or feel they have ‘problems’ with start times.
Now I know I’m getting old…
Be honest, does anyone else read some of the above and just see
Blah, blah, blah 45, blah 60 blah 3rd week blah holiday blah make up blah…
This is in no way a reflection on all the posters who obviously have grasped the rules, but more on the fact that my brain seems to be turning to mush as I approach my senior years.
I’m still amazed they let me drive a truck to be honest.
