Weekly Rest.......is this legal?

Hi all,

A colleague of mine has asked me if this is legal. I think that because the weekly rest of week 3 straddles midnight it is but I wanted to get confirmation from the experts!

Yes it is legal. Regular weekly rest week1, reduced week 2 and regular week 3, assuming he doesn’t start until after 03:00 Tuesday week 4. He has 8 hours to compensate for before the end of week 5 for the reduction in week 2.

A weekly rest which begins in one week and ends in another can be counted in either week but not both, so the week 3 rest is no problem.
