Weekly rest help

Sorry if this has been asked before, I have been asked if I can work 3 Saturdays. I never usually work weekends. My normal weekly hours are 7-3 Monday to Friday. I have been asked to change a few days around and am unsure if it is ok.

Week 1 normal week + saturday 7-2 (41 hours rest til 7am monday start)
Week 2 M7-3, T day off, W7-3, T7-3, F7-3, S7-4 (39 hours til monday start)
Week 3 M7-3, T day off, W day off, T7-3, F7-3, S7-5(38 hours rest)
Week 4 M7-3, T7-3, W7-3, T7-3, F7-3(62 hours rest til 7am monday)

The average driving hours should be about 5 hours each day. I have had a look at the EU rules on weekly rest but am unsure if the days off during the week can be counted as compensation for the reduction in weekly rest on the weekends. If this is not possible I will just work the first and the third Saturday and forget about the second.

Thanks in advance
Les.

Ok, don’t take this as gospel, I’m just posting this answer to see if I understand it - and hope to be corrected if I’m wrong.

I don’t think this is legal as neither week 1 or week 2 contain a 45hr weekly rest.

However if you can get the Wednesday off in Week 2 instead of Week 3 this can then be counted as your 45hr weekly rest: so you will have a 45hr w/r every other week.

Week 1 normal week + saturday 7-2 (41 hours rest til 7am monday start) [4 hr comp taken in week 2]
Week 2 M7-3, T day off, W day off (64 hrs rest), T7-3, F7-3, S7-4 (39 hours rest til monday start) [6 hr comp taken in week 4]
Week 3 M7-3, T day off, W7-3, T7-3, F7-3, S7-5(38 hours rest) [ 7 hours comp taken in week 4]
Week 4 M7-3, T7-3, W7-3, T7-3, F7-3(64 hours rest til 7am monday)

I am not going to try and answer this as I usually get shot

hope you are right or Coffeeholic will shoot you

Thanks for the welcolme and replies.

I was hoping that the compensation for a reduced weekly rest period could be added to a daily rest period and that if the compensation was taken before the 2nd weekly rest, then the 2nd weekly rest could also be a reduced weekly rest period. I will just have to miss the second Saturday and work the first and third.

Maybe COFFEEHOLIC can shed some more light on it.

Thanks

Les.

The compensation for a weekly rest can be added to a daily rest period but the regulations still say that :

In any two consecutive weeks a driver shall take at least:
two regular weekly rest periods, or one regular weekly rest period and one reduced weekly rest period of at least 24 hours.

So the hours you’ve posted are still illegal even though you’re compensating for the reduced weekly rest (Well that’s my opinion anyway ).
