well heres one for you all I work either a sat or sunday after 5 days mon tue wed thurs fri
I done a cpc course he said its illegal to work mon to sat then mon to sat week after I said you have third weekend to compensate and as long as I do 45 hrs rest then say run back n sat morning week after say 4 hours still have 45 hrs rest I think you could work every weekend if you were 45 rs rest example
week 1 mon to fri then sat 6 hrs total hrs 57 rtw wtd after breaks and poa rest 32
week 2 mon to fri then sat 4 hrs total hrs 53 rtw wtd after breaks and poa rest 45
week 3 mon to fri total hrs 59 rtw wtd after breaks and poa rest 45 + 13 = 58
obvisly depends on finish time fri or sat and start time Monday
in blunt he said you cannot work 6 days a week for two weeks off the trot , if I do 2 weeks off the belt I have to have 2 weekends off. what do you,s think thanx gothika

Sounds like another of ‘my colleagues’ doesn’t know what he’s talking about - really ■■■■■■ me off and helps make a laughing stock of the DCPC. Thee again - I suppose you might not have fully understood what he said■■? Week 1 and 2 have sufficient rests of the right length and weeks 2 & 3 have more than enough.

From the limited information you have given the pattern is legal for the weekly rest requirements. Your week 1 rest needs compensating by Midnight Sunday of week 4 so it looks like you are compensating early - that’s fine.

Basically - what this so called DCPC trainer should have told you is that in any two consecutive weeks there must be AT LEAST 2 regular (45 or more hours) weekly rests or AT LEAST 1 regular and 1 reduced weekly rest with any reduction to be compensated by the end of the third week following the week in question. A rest that starts in one week and ends in another (i.e. spans midnight Sunday night) can be COUNTED in either week but not both.

Yes you can work Monday to Saturday every week depending on number of hours rest taken
Yes you can work 6 days a week for 2 weeks
Yes it is possible to reduce a weekly rest twice (or more) in a row and still meet the requirements

Where did you do your DCPC?

As long as at least every other fixed week has a 45 rest then the driver is legal as long as all other rules have been followed

Is your mon to fri job under EU regs? - if not then basic WTD and RTD do not get added together

If asked if doing mon to sat for 2 weeks on the trot was legal then most would be right to generally say no initially but then would need to probe deeper for a more definitive answer

No is the answer to the way you posed the question

You could SHOW two reduced weekly rests in a row but the reality would be different …

This scenario is legal …
Take a weeks holls and start back on Monday
The last 45 hours of the holls are used as the regular weekly rest for the first week back after the holls (WEEK 1)
Work mon to sat = WEEK 1
Sun off = reduced weekly rest
work mon to sat = WEEK 2
Sun off = reduced weekly rest
Work mon to fri = WEEK 3
Sat + sun off = regular weekly rest for WEEK 3

That leaves WEEK 2 with two reduced weekly rests which can be used for it so choose one of them leaving the other as a weekly rest no used for any WEEK and does not need compensating for
Most would choose the reduced at the start of WEEK 2 to be used for it and then use the one at the end of WEEK 2 as payback providing there were enough hours to do so

A weekly rest that includes sunday midnight can be used for the fixed week ending or the fixed week starting but not both

Probably - but it’s probably safer not to. It’s a once in a while situation and can’t be repeated again until you have a long weekend or holiday to recreate the situation again.

As long as any two consecutive weeks have at least 2 weekly rests counted/within them and one of them is at least 45 hours thenyou have complied

As Rog has pointed out, some reduced rests don’t even need compensating for.

I find a lot of people who’s weekly rest pattern is illegal … sometimes just but still illegal.

They tend to be working for restricted licence holders who have no idea and in some cases refuse to change things when it is identified

The first week back at work has a regular weekly rest used for it at the start of that week
This week you had a regular weekly rest at the start of it = last sat+sun

Working this sun also means you have an extra reduced weekly rest for this week

At the end of next week you can have a reduced if you wish BUT watch out you do not exceed the 144 hour rule such as start this sun at 0600 means the next weekly rest (reduced or regular) must start by next sat 0600
