now this should be easy to answer but i think i’m confusing myself,
i left malaga on tuesday after having sat, sun and mon off so more than 45 hours off and nothing to pay back.
i tipped paris thurs morning but no reload until fri so i had 26 hours off in paris.
i’m now parked in burgos on a weekend rest because my tip is on monday, so my question is,
do i have to take 45 hours now because i took 24 on thurs and can’t do 2 x reduced rest in a row or can i do a reduced rest as long as i have a 45 before next weekend?
thanks in advance

There’s nothing to stop you having two consecutive reduced weekly rest periods if they’re in the same week and you have a regular 45 hour weekly rest in both the preceding week and the following week, so you can have another reduced weekly rest period now if you wish.
You will need to pay compensation for whichever is the longest reduced weekly rest period but not for both of them.

so if I have 36 hours here I only owe 9 next weekend and the 26 I took in paris was just a long 11

That’s right yes, the 26 hours you had would have allowed you to start a new six 24 hour periods if you’d needed to, as it is it’s just a 26 hour long rest

Best you don’t take a 45 there unless you are in a hotel or the like. If you are in the truck it would not be legal.

if its illegal then neil, how do the flipflop and sock brigade get away with it? there’s hundreds of them parked up all over europe every weekend for their 45hr breaks and they don’t book into a hotel

No idea, but the regulations do not allow a full weekly rest to be taken in a vehicle. You can only take full and reduced daily rests and reduced weekly rests in a vehicle.
I know but if the spanish and french have a chance of making us pay a fine they will jump on it, there’s a bloke parked next to me Ukrainian in a porky reg truck been here since friday and leaving monday. not only is that illegal and deserves a fine but how do non EU citizens get work in the EU when surely its only if you have a skill which is recognised as being short staffed in the EU that you can enter the EU to work

Maybe they haven’t cottoned on yet, I’ll email them.

if only you could, then when we have to return home every 2 weeks and they keep tramping for months on end we could compete on an even playing field

I meant you would be in the digs.
I wouldn’t, if it can’t be done from Malaga between 2 weekly rest periods it doesn’t get done by me
the furthest we go north is Sweden to Malmo which means full weekend at home then 5 days there then a 24 hour somewhere on way back and 5 days back. we do go to greece rarely or further east but only after full time off before and after, none of that long weekend malarky
