there are some safeguards regarding a driver going on the ■■■■.
shut the curtains before going on the ■■■■,
get in from the passenger side when returning to the vehicle,
there’s always a chance that an over zealous copper will arrest the driver, but the cps wouldn’t take the matter very far as long as the police can’t prove intent to drive.
As long as you are free to dispose of your time as you wish, it can be counted as a 45hr rest. When VOSA park up foreign drivers for insufficient weekly rest, they don’t force them to use a hotel.

I’m thinking as an ex JDR man ND also means the silly things one does when on the ■■■■. Like that 2am cook up you fell asleep doing or the keys you lost on the beer in town or the needing bailing out after the young ladies boyfriend caught you etc etc

- Where a driver chooses to do this, daily rest periods and
reduced weekly rest periods away from base may be taken in a
vehicle, as long as it has suitable sleeping facilities for each
driver and the vehicle is stationary.

I’ve done far too many weekends away and not once have I acted as a Security Guard.
At H&S I think we got eight hours waiting time plus allowances for each day parked up.
Naturally we got overtime rates for weekend driving so it was considerably more worthwhile to crack on.
It used to make me smile that while we would think up excuses to carry on, my friends at British firms were thinking up excuses to park up…

Well for those who don’t pay the drivers if they need to take a 24 or more so a 45hr break whilst out on the road, i can see an increase in pilfering from trucks only increasing, as the driver will decide to leave the truck at say a service area and get a cab into the nearest town or city book into a cheap hotel, and really have the weekend off (zb) the truck & it’s load (if loaded) a few cab break ins stolen units trailers they will find it was cheaper to just pay their drivers normal day rate plus any tax free subsistence money inc night out money ,
Because if the driver is being paid the company has a say in what the driver does to a degree, ie don’t be leaving the truck all weekend But don’t pay em, they can do as they want

I’ve met plenty of British drivers while working abroad and not one of them upped sticks to a hotel on a regular basis wether they were being paid to park up or not.
If a firm can’t pay proper subsistance for a weekend away what are the chances that the driver will be able to afford digs anyhow?

Formula 1’s aren’t exactly expensive you know,neither are a lot of flights to & from blighty , my answer was more hypothetical though, if they won’t pay the driver they cannot expect to have a free security guard to guard the truck and load , if i was in the uk and not too far from home there would be no way that i would stay with truck & load , and it’s not that most of these companies can’t afford to pay the driver properly it more of a case of them simply not wanting to, that shark that i worked many years for always charged extra for weekends and will still do that now,
But the best practice would be simply not to work for such a company ,
