I read this BS all the time with drivers moaning about poor working conditions but yet none of them can see the bigger picture that the only people to blame are themselves . You need to pull yourself together man. What does your contract state for your working hours? Don’t tell me you signed for variable start times? If you did then you’ve only got yourself to blame.
If i’m not standing up to them and challenging them, what the hell am I doing asking whether what they are doing is legal, and trying to change things? I am challenging them, and by doing so, I HAVE changed things. We now have assigned start times.
This isn’t the only thing i’ve challenged them about, they hate me working there because I don’t just roll over and take it. But I don’t go in shouting my mouth off until I know the facts.
And FYI, my contract says any 5 from 7, 45hrs a week basic, variable start times to suit operational requirements within a 3hr window etc, etc. As i’m on Mon-Fri, and working hours that suit me, I don’t want to rock the boat too much by being another loud-mouthed [zb] of a lorry driver.

You seem to have completely missed the point of my post. Its not about my hours or contract, i’m happy with those, it was about whether ringing the office from home signified the end of my rest period. I challenged them about it, and asked on here and with VOSA what the legal implications were, but before I got a reply from VOSA, the situation changed back to how it had been for the previous 2 years.
So can you clarify the point you are trying to make, or are you just trying to have a pop at me for no reason?
I have variable start times within a 24 hour window. Usually I know at the start of the week what I am doing for the rest of it but occasionally I don’t. Last Wednesday I finished at 09:00 and I asked what he had planned for me for the rest of the week but he said he hadn’t looked at it yet and would text me later, fine by me. That afternoon I got a text with what he wanted me to do the next day. I didn’t fancy doing the run he put me on so phoned Jimboy124 and we swapped duties and I then called the boss and told him about the swap. It all took about 5 minutes and do I think I didn’t get proper rest or it interrupted my rest? No, I know by the letter of the regulations it did but you can worry a bit much about that and sometimes real word common sense comes into play. No one would even know I had done it, well apart from anyone who reads this but you get my point. I have a dead easy job which requires very little effort and pays good money so I’m really not going to worry about the odd phone call or text during my rest period.
In the middle of typing this I got a phone call from another driver from our place asking me about his hours and what rest periods he needed, I sorted that for him but I guess some people would say I shouldn’t have as I am on my weekly rest.
It all depends upon how the call(or txt) impacts on your home life. If they messaged me within 3hrs of the END of my shift, thats not a problem because i’m awake, cooking, eating and chilling out. But sometimes I sleep right up until an hour before I start work, simply because I need to(and especially after a long shift), so getting up to make a phone call would interrupt my sleep if i’m then not starting work for hours, even though legally i’ve had sufficient daily rest, and I wouln’t be able to go back to sleep until I needed to get ready for work.
