Can someone give me an e-mail address for VOSA please, I need to ask them a question, ie
If I have a week off, then start work on Wed with a clean sheet as no reductions to pay back, and I work Wed, Thur, Fri, Sat, Sun, Mon, say, 10 hours a day, with about 7 driving each day, then have 24, then Wed, Thur, Fri, Sat, Sun ,Mon, then have 45, then Thur, Fri, Sat, Sun, Mon,Tue, and then have 7 days off, and do it all again, is this ok?, basically, a 6 followed by a 24, then 6 followed by a 45. then 6 followed by a week off. I don’t see that there is anything illegal here, am I correct.

I would have had a go at answering your question but my head can’t get round other people’s hours, if that makes sense, and I won’t want to mislead you.

Looks alright as you’re paying the reduced weekly rest back by the end of the 3rd week but ill never get my head around “fixed” week or “within a” as long as I live so you probly don’t want to listen to me. :slight_smile:

mon tue = off so full weekly rest for week 1
wed thu fri sat sun mon = on
tue = off so reduced weekly rest for week 2
wed thu fri sat sun mon = on
tue wed = off so full weekly rest for week 3
thu fri sat sun mon tue = on
wed thu fri sat sun mon tue = off so full weekly rest for weeks 4 and 1 again

7 hours per day driving time is nowhere near the max

Having read through it, I can’t see a problem.

6 days of 7 hours is 42 hours driving.
5 days of 7 hours is 35 hours driving.

Neither over 56 for weekly limit.

Totalled fortnight is 77 hours therefore under 90 hours fortnight limit.

All under 9/10 hour daily driving limit.

Thanks guys, that’s pretty much what I thought, I am having a stand up argument with my Agency at the moment, they say it’s not legal, but I have experience behind me and a wealth of knowledge that these [zb] have no idea of, ■■■■ agencies.

Looks OK to me, I can’t see anything illegal about it.

Well as far as I can see the only complicated component is repaying the reduced weekly rest of 21 hours by the end of the 3rd week, this has to be repaid by the end of the fixed week i’d say may be your only problem, then you would need to have a 45 and repay the 21 hours from the reduced 24. The fortnightly 90 hour driving limit is easy to police.

Dunno why they just don’t simplify it and say you need 24 hours off every week, if you kip for 24 hours, you’re good to go for another week, all this reduce and pay back by the end of the third, how is this improving driver fatigue? It’s bloody fatigueing trying to work it out, I just generally get it about right and hope for the best. :smiley:

No problem for the OP as the reduced in week 2 easily gets paid back in week 4

Why do so many assume that a reduced is always 24 hours off when it could be 44 hours off for example ?

Agency reason ROG, I was telling the girl that this was the pattern I wanted to work to so I could sort of maximise my hours, ie, get six shifts in, in each of the three weeks, then I bugger off home to France for 7 - 10 days, then come back and do it again, then this other right snooty bird jumps in and says " you cannot do that, you must have a 5 day week and then a 6 day week to comply with the regulations", well, I bit the tongue a bit and tried to explain that this was not the case and that you could really do six week nearly every week, as long as you complied with the daily and weekly rest rules. Well, she jumps in again and starts stamping her foot and says she will have to speak to her compliance man, who is the knowledgable bloke in the Agency about the regs. I just said, “whatever” and left before I started kicking her ■■■ around the office.

All you could do is to print off the relevant regs and put a yes/no tick box for her to see if you have complied to the regs
