Where are the penalties for RT(WT)R non compliance?

I can see nothing for non compliance of breaking the 6 hour rule, the average 48 hour working week etc

you won’t find the penalties for contraventions of the Road Transport (Working Time) Regulations in the ESP. The ESP mainly deals with Fixed Penalty stuff, or what to do if offences exceed the guidelines for Fixed Penalties. Offences under RT(WT)R were not included in the FP schedules, hence they have to be dealt with by the Courts.

If you look in paragraph 17(1) & (4) of SI 2005/639 you’ll find that exceeding the limits imposed eg 6 hours, is a level 5 offence, up to £ 5 000.

Why does it matter? It certainly doesn’t affect you as you don’t do the job and haven’t for years. As Tachograph says you really need to change the record; we get it you want it enforced rigidly but it isn’t happening and probably never will be. Some companies like to enforce it so some drivers have to comply with it, others don’t but almost without fail whenever somebody asks a WTD question you cannot wait to post asking why it matters or telling them not to bother because no one has been done for it. Give it a rest please.
