VOSA and Overloading FPN's

Before I ask my question I have to state I havent done anything wrong lately , its just a question I would like your views on :slight_smile:

Now that VOSA are handing out fixed penalties for overloading I wondered at what percentage of overloading they would start issuing them .Im talking about gross weight here not individual axle weights.

On a 40 ton artic a 1% overload on gross weight would be 400kg , 2% 800kg 3% 1200kg etc etc , at what percentage of overload do you think they would deem it neccessary to issue a fixed penalty ā– ā–  …and also does the fine rise the more percentage the vehicle is over weight ā– ā– 

The way vosa opperate it probbaly goes up by the kilo :wink:
But you used to get up to five percent leeway so it by rights has to be something like that still

0 up to but not including 10% £60.00
10% up to but not including 15% £120.00
15% and over £200.00
The legislation shows that a £60.00 penalty will be levied for a 0%-9.99% overload, but VOSA examiners will allow a 5% tolerance before Fixed Penalty or Prohibition issue unless the relevant weight has been exceeded by 1 tonne or more.

So looking at that Coffeeholic you would get away with being about 990 kg overweight on a 40 tonner which is approx 2.5%…if you grossed 41001kg then you would get a Ā£60 FPN…a 5% tolerance would take you up to 42000kg and obviously they are not going to let you get away with that…next question is…lets just say you got pulled in by them and you weighed in at 41001kg , they issue you with a Ā£60-00 FPN and then what ? do they let you go on your merry way or do you have to arrange to unload the extra 1001kg ?

When I got done for over weight on the front axle on an 18 tonner, i got fined £400 and that was twenty odd years ago! I was3/4 of a ton over weight on the front, and after I re distributed the load and was reweighedI was allowed to go, and told not to worry about it. about a month later i got a summons. total gross weight was 17.5 tonnes.

dont think they let you go on your way, what if there was a subsequent accident and VOSA knew you were overweight but let you go on your merry way as you put it, think you & them would face a real battering from the claim here.com solicitors. never been in that situation personally but have seen lots of offloaded goods left at VOSA weigh sites presumably to be picked up later.

it’s cheaper than it used to be.
it was always Ā£1000 per ton for the opperator, or Ā£100 per ton for the driver. But the 5% tollerance hasn’t changed.

There is still a 5% tolerance or 1 tonne, whichever is the smaller. So if you’re looking at a 44t artic combination you won’t want to be exceeding 46t and not 46.2t (which is the 5% figure). If you take the drive axle of said artic you don’t want to be going over 11.025t (which is 10.5t + 5%) rather than thinking you’re OK at 11.5t.

If the driver gets a fixed penalty then the vehicle will be getting a Prohibition until such time as the overload is removed. I recall a few years ago a bulker carrying carrots, trust me a three ton pile of carrots is a mighty big pile of carrots. Wish Bertha had been around then, carrots would have disappeared in very short order. It is highly unlikely that overloaded vehicles will get a ā€˜direction notice’ unless removing the excess load would cause a real problem on site, the word bullocks springs rapidly to mind :smiley:

You could always scare the bullocks and the driver could clear the result out of the load space, that would lighten the load. :wink: :stuck_out_tongue:

I am with Phil on this one, a £££grand was the deciding factor, you don’t need many of them in a month :blush:
