Just seeing if anybody on here is clued in to the rights of a verbal contract .Ive googled it and there is lots of definitions of what’s right and wrong by both parties, spoke to an owner driver today who reckons in haulage it is a bonding contract stronger than in any other industry any real advice would be much appreciated
Always understood that a verbal agreement had the same standing as a written one.
The problem is in proving the verbal contract exists.
Verbal contracts are great, till you bring something up and the gaffa says ‘show me it in writing’ with a big grin on his face

Your friend has mis-informed you.
As Del says, a contract is a contract whether verbal or written
Nothing special about the transport industry.
You will need to prove it in court.
No good, it has to be in writting, if you went to an employment tribunal for unfair dismissal the judge will need to see the contract, you can not say my mate down the pub told me.
A lot depends on the context but in general a verbal contract is as legally binding as a written one. As mentioned its just harder to prove a breach.
Which court track the case is designated will depend on the amount of losses involved and if say it was a small claims matter for a civil breach of contract it would have to be proven on the balance of probability’s.
Afaik it needs a witness for it to become a verbal contract. the more the merrier I suppose.

The contact is between the parties full stop. No paper is required, that said, proving it is the problem.
Proving you have one might be a matter of having witnesses or perhaps previous payments etc.

I think you will find that the law states that in European and British employment laws you musy recieve a written contract on the day you comence employment, even if you are a temp. Any company that does not issue a contract is liable for prosecution.
A verbal contract is not worth the paper its written on or not as the case maybe verbal contracts are or can be virtually impossible to prove.
