van driving

i heard this from the driver concerned
mon - fri truck driving
sat down to poole back brum in van
sun 2200 run to aberdeen back to peterlee then to brum
nice run where did he have a night out

he didnt

i says what happened to 10 hours driving
him theres nowhere to stop :frowning:

I guess the guy doesn’t want to get caught. Doubt if he managed to get an EC weekly rest period between driving on Saturday and starting Sunday. ‘Rest’ = a period during which a driver can freely dispose of his/her time. Like you said, what happened to the 10 hrs driving and 11 hours duty limit whilst van driving? Don’t think that the answer of ‘nowhere to stop’ would work in Court. Is there really nowhere to stop between Peterlee and Brum? Guess he started HGV driving again on monday or tuesday, HOPE he’s not driving anywhere near me or the family!
The daft thing is that if his HGV driving during the week is classified as Domestic Hours the same scenario would be almost legal.

he was most probably under the impression that because the van didn’t have a tacho it wouldn’t show up anywhere… he’s right it doesn’t, so he’ll be one of many that do it.

Until the VOSA go and pull his timesheets. “What have you been paid for here driver? You must have been working to be paid.”
