Using holidays as weekly rest

I used to do this in my old job but my new employer says its not legal because when you book a days holiday,they register 8 hours working time .
So basically I used to work mon to sat one week,then book one days holiday the following Monday,then work Tuesday to Saturday,so that way,I was getting 6 days pay every week.

Whether or not a day off is paid or unpaid, seems irrelevant to me. A day off is a day off.

So…you were working 6-on and 2-off on a permanent basis?

No,it was straight mon to friday,rest day every Saturday,one day holiday every other Monday to make the 2 days off required

A day holl counts towards WTD but not tacho regs which counts it as rest

He’s mixing up EU Drivers Hours Regs with Working Time Directive.

You can lead the horse to water, but you can’t make it drink. If this is the standard of TM, possibly start looking elsewhere.

And also to add, the 8 hours they log for the WTD doesn’t count towards your weekly max of 60, it is only included in the total to work out the average.

And only 20 days of your holiday of at least 28 entitlement (for a 5 or more day per week worker) count as 8 hours per day or 48 for a fixed week off, anything over this counts as zero

Think he means working a rest day on the Saturday, thus having the Monday off as annual leave to make his two off.

Theoretically depending on start and finish times you can work a Saturday and still have a 45, if you’re done by 12:00pm Saturday and don’t start again until after 9:00am Monday.
