we had quite a heated meeting yesterday as explained I had spoken with VOSA regarding the situation,never mentioned our company,i said that a transport manager should have been employed a few years back as no one has been legally responsible for the operation of the fleet.i have been doing it but I am not the cpc holder & vosa are not aware of me running things. my main problem is I have said that when the TM1 form is filled out it asks for the name of the transport manager & then when that is processed by the t/c’s office I become the transport manager,the company is saying that the position & title of transport manager does not exist within the organisation. I am very frustrated to say the least,as I will be taking all the legal duties of a tm on,but without the title within our business.everything stops with me but my job title at work will still be a supervisor.
do you think I am wrong in asking for the recognised title of TM for the job I am doing or should I just take the payrise & be holder of the cpc.
I’d rather have a pay rise then a title. As long as you and your employer know what’s expected from each other and neither tries to move the goalposts then don’t worry about what you’re called. I’m sure in your new position you’ll be called all sorts of things you never knew existed.
I’ve been looking into this a bit more & have found out that they are not complying with the terms of the O licence as they don’t employ a transport manager & they should have as the chairman is the CPC holder & hasn’t had anything to do with the running of the transport in years.
I have been doing it for past 17 months but I’m not the cpc holder,even though I have the qualification & vosa aren’t aware if these changes.
the company run on a uk standard licence so by law they must employ a transport manager,so for the company to say that the position of TM doesn’t exist in the company is wrong & possibly also illegal
Find it a bit odd that a firm with so many trucks that’s operations require a standard national, so presumably engaged in haulage, are so ignorant of the legal requirement to employ a transport manager. Is it one of these firms that would normally run on a restricted but upgraded with a view to a sideline in haulage?
I really wouldn’t push it, the money’s not great but, a few years down the line with some experience under your belt you could walk into any number of better paid transport manager jobs. Regardless what job title they want to give you it doesn’t matter, as far as your CV goes, you are/were the nominated transport manager and this is absolutely no sort of lie, exaggeration or untruth.
they started off delivering their own products & then got into recycling so went to a standard licence due to that as they bale the waste & sell it on.
I guess I shall stop a supervisor by title at work then,although anyone in the know will recognise I am the TM,will see how things pan out.
have another meeting tomorrow to finalise things & have a few docs to show them to
prove that a TM is a legal requirement.
