Urgent advice required

I recently got a job with a certain distribution company. I got the straightaway and told the TM that I had an assessment drive with a well-known orange and white company. I was up front with them from the start and they were fine with what I told them and took me on. I worked one full week, then the following Thursday was told that I had an assessment with the orange and white company. So I was straight on the phone to my TM and what he said was “if you go for the assessment then you may not have a job. Goodbye”. On the Sunday I rang and rang the TM mobile to see if I had a job. He didn’t answer the phone.
I was due to be paid on Thursday the 3rd march and no payment went in the bank. Now I have received a letter saying that I have not handed tachos in and that I will not be getting paid and if I do not hand them in then he will be reporting me to the ministry of transport (or something on the same lines). I KNOW I HANDED THEM IN AND ALL THIS IS A LIE. I rang them to see what was going on and got nowhere. WHAT SHOULD I DO :question:

Next ? the letter is only stateing that you never handed in your tachos
it is your word against his and you need either to talk to your union or
a good lawyer who deals in traffic+transport ask on the site one of the
members will have a name for you.also I would think of talking to VOSA
and asking for some advice as they may be able to put this TM staight.
AS when you talk to them and explain the situation you may find that
what we think of as a bigbad wolf (VOSA) turns the problem around and
it is the TM who is in the proverbial cess-pit

I agree with pete. Get your own side of the story on record first.

Then work out how much they owe you. The Citizen’s Advice Bureau can help with working out deductions, then off to the Small Claims Court.

Think about what trips you have done and on what days. Does your name appear on gate passes? Where did you get fuel and what receipts did you sign? What premises have you delivered to where you may appear on CCTV. Start making a list before the memory gets too hazy.

The very fact that you have posted the circumstances on this site can be considered as supporting evidence of the circumstances, but it would need to be authenticated by someone representing the site. A ■■■■■■■■■■ and drawn out procedure, but it can be done, if necessary.

They cannot withold payment, I would ask to speak to the Personal dept (if they have one), What he is doing is ILLEGAL, You cannot withold wages. Personally I would just report him to the police for theft (he has stolen your wages), As for the tacho’s just report the whole company to VOSA and sit back and watch the TM go into overdrive to get all his records upto gether. Failing that, pay him a visit with an Iron bar, I have found it to be quite a good barganning tool :smiling_imp: :smiling_imp: :smiling_imp:

In most instances I quite agree, However, If someone is playing about with my wages and causing my family hardship because of it then I will stick the pen where the sun don’t shine.
