Seems to me they are not paying for your spit rest break. As you have no terms and conditions agreed, there will not be much you can do about it. Give them a call in the morning and just ask them why they deducted the 3 hours from you and if they say that they don’t pay breaks at least you know for next time.

Don’t accept agency work unless your terms are clearly spelled out in writing beforehand, it is always good practise to print out your tacho, as you did, at the end of your shift as proof for yourself that you have indeed worked the hours you claim. If you work for an agency that does not pay your breaks, next time put it on POA instead and see what they do then. POA is a great tool for agency drivers working for companies that will not pay breaks, you are available and are only limited by the hours in the day, you are not refraining from work, as they can claim when you put it on break.

You don’t really have a lot to stand on here, let it be a lesson for next time. Not all agencies or employers for that matter are like this, as with everything else you need to seperate the wheat from the chaff.

Right, the verbal agreement between yourselves forms a contract of which you fulfilled you part in full. You have proof of the hours worked and are not trying to fleece them. Telephoning the office is not the way to go about this, get your backside down there and demand to see the boss, tell them you are not happy at being ripped off and unless they address it to your satisfaction right now that you will have no option but to take it further.

If they dare you to do so then pick up their laptop and drop a pre written note onto the desk saying property taken in lieu of payment owing. Believe me, they will suddenly want to pay you.

Stop being a nice guy, this is what the agency expects and they know they can ■■■■ all over people like you day in day out and this is why they get away with it.

In all fairness the agencies push guys onto stuff like this. I’ve read questions on this forum like what are my holiday pay rights, can i get sick pay off the agency,…when i’m self employed etc… its quite a sad state of affairs. Some agencies have a lot to answer for.

Any news on this Boycie, you must have got through to them today?

I’m still trying to work out how a self employed driver can afford to do one hour’s induction unpaid…!!!

ALWAYS get the deal in writing. If it isn’t in writing, they WILL try and cheat you. No agency is ever always honest.

Remember the above and you will avoid getting shafted in future… :sunglasses:

Anyway how did you get on. Did the agency promise to cough up. Tell them you have a printout, verbal contract and will be using moneyclaim online to try and get your money back- best sending a few letters first though.

Spoke to them yesterday and saying that the client I worked for said I started at 8am and finished at 6 bs so I sent a copy of print out to agency to proove that was actually in from 0515 to 2000 see what happens she said if you invoice us for 10 hours then sort out the other 3at later date does she think I’m simple I said no will be having the whole amoount

Thanks for your advice now take some of mine rearrange this buddy off ■■■■ that’s my thickness coming out as can’t spell properly now if you would like to advise me on ts and vs then feel free but if all your going to do is ‘I told you so’ then the above still applies I no ample se drivers that don’t have ts and cs…

Also was a induction not assessment and rouund my way that’s how it is I am far from thick. I
