unpaid work!!

Hi folks

Need some advice please… I got my first claas 2 job for a company that shall remain nameless. First week was great…training… driving… getting to know the customers… second week out on my own. Now this company are based in devon and drive the truck up every night… so its loaded by them and I have to deliver in the order its loaded… no problem first week… loaded in order so there was no to and fro all over the place.
Second week I’m on my own and I end up wirh a full wagon… I check the notes and couldn’t believe how it had been loaded… birmingham… then cannock…then great barr… then walsall… then Birmingham again… I was really unimpressed…anyway… 15 drops in total… managed 10 by 16:30 and now I’ve been working 11 hours… I phoned the TM and explanied the problem and was told to finish the run… I tried to explain that my hours would go over but he wasn’t interested… anyway… I told him I wasnt going to break my tacho regs and that I was taking the truck back to the site and quitting… now 2 weeks later andive still not been paid for the days I worked… any advice on how I can get paid off these people??

Did you sign a contract

Suggest first stage is to simply write them a letter stating the days and times you worked and ask for wages. (don’t suppose you were on analogue tacho, or have any printouts?)
Any limited company is obliged to respond to correspondence. Best of luck.

Yes I did sign a contract… 3 months probation period…
No print outs as they downloaded the info weekly and said i didnt need any… ive emailed them tice with no reply

Signed for letter/invoice detailing the hours you worked and the money you are owed.

Tell them they have (say) 14 days to pay you in full or you’ll issue a county court summons for the non-payment without further notice. And if they don’t pay you can issue the paperwork online for about £30 depending on the amount. You’ll get the costs back and if you are sharp and they don’t stick to the time scales you should be able to get a default judgement against them without ever getting near the court.

I’ve needed to do this once or twice.

Send a recorded (signed for delivery) letter stating the facts, that you worked for them on such & such a dates at an agreed rate of pay of £■■ & that you have yet to receive your wages. Give them 1 pay period to pay you in full ie. if paid weekly then 1 week, if paid monthly then 1 month.

Don’t request an exact amount unless you’re confidant you can work out the statutory deductions accurately, getting the amount wrong can work against you.

If this doesn’t get you paid then either use Money Claim Online or the Employment Tribunals Service to claim for ‘Unlawful Deduction of Wages’.

If you have done work for an employer & not received your wages, the employer will find it incredibly difficult to defend.

If you are sent any money for less than what you expect then do not accept it, let the court sort it out.

Bit poor show not being paid , but to be honest if they drive the truck up to Brum for you it doesnt sound like a really hard work load, its not really your concern how its loaded , you do it in the order they tell you simple really .
They will pay you in the end , I guess they are probley just ■■■■■■ off after training you that you had a turn and jacked it.

Yeah… I don’t think they drove it to brum for my benefit… its because they don’t have a depot here
It was loaded onto pallets… half for one place… another for someone else… so there was a lot of handballing into shops… plus cash and cheque collection

It does concern me when I’m delivering it!! If its loaded in the wrong order its more time consuming hence going over my hours…

And as for training me… I was shown by an agency driver that was paid to to the drops anyway…

Well put it down to expierence and chase ya money and find something better next time , something will come along if you look harder enough :sunglasses:
