I have often wondered how the question on any future interview is answered.

When i went through mine, the solicitor was very honest. Asked what i wanted in the way of compo, i said a years wages, she said unlikely but it’s a starting point. Company made offer of Ā£500, refused. The industrial tribunal date approached, they finally admitted liability, but denied responsibility, not sure how they can when they’ve admitted liability. to cut a long story short, i got 5K, way way short of a years wages, but apparently they argued the years wages, and the 5k was their final offer. Could have gone all the way, but on briefs advice i was unlikely to get anymore, may have even got less, so took it and ran.
The tribunal would not have been held in magistrates court as it was not a criminal offence and the bench would have been employment lawyers as magistrates do not rule on these matters

Lost of earnings from the 3 months of unemployment is the main thing, I can claim because my new job pays less than my old. I’m entitled to some compensation due to them never giving me a contract in the 24 months I was there. All that’s before I start on the holiday money and wages they owe me!

Lost earnings and now less pay at your new job have nothing to do with them, all they owe you is your holiday money and any wages, nothing more, nothing less.

A written copy of employment isn’t legally required.

There’s been some useful replies on here and some advice to take. I’m not even sure how much money to expect should everything go in my favour. I’ve gotta go and fill a financial loss sheet out in the next few weeks so I might get a better idea then.

I also know that my claim is for compensation instead of reinstatement.

I hope they do settle out of court, although I’m not feeling so nervous about the whole court thing now :slight_smile:

I know in my case I had a figure in my head and tbh nothing else’. All I wanted was my day in court to see the company owner squirm with embarrassment. This was a Christian company that preached Christianity and how good they treated their employees. In my case I was physically removed from their premises on Xmas eve at 5.15pm for refusing to do a delivery after having worked 11hours but only driven 6. When they realised I was prepared to go the whole way to court they couldn’t pay me quick enough. Only thing was I had to sign a confidentially clause but I walked away with enough cash for a family holiday to Florida and change my car so I’d have signed anything. Still nice to see the company owners face when he realised how much he had to pay me on the advice of his barrister lol. Good luck and don’t let the ā– ā– ā– ā– ā– ā– ā– ā–  get you down :smiley:

Your kind, that’s a strange thing to say to someone standing up for themselves what he should be saying is well done go get as much as you can and next time they might treat there staff better.

I agree. I cannot understand people who think we should enjoy being bent over and shafted by employers.

Nice to see that you got your compo mate, the people on here moaning at you about being greedy etc can stick it! If you feel you have been treated wrongly by your employer you should stand up for yourself!
