hello got a job driving refuse lorry for the local council but they run on tacho card.
they come under uk domestic drivers hours?
is that 6 working/driving mixed you need to take a 30 mins break ?
any help to clear this up would be help full

if its for the council dont worry, the other guys will take breaks well within the legal max⌠but the max is 6 hours work or 4.5 hours driving before a break, whichever is soonest. 15 mins for the 6 hours and 45 mins for the 4.5 but councils do not like to see infractions

When youâre working to domestic regulations you can forget the RT(WT)R 2005.
The RT(WT)R 2005 only apply when youâre driving to EU regulations.
When driving to domestic rules you come under the general WTD otherwise known as âThe Working Time Regulations 1998â, the only stipulation I can see is that if your daily working time exceeds 6 hours youâre entitled to a break of at-least 20 minutes but it doesnât have to be taken before exceeding 6 hours working time.

No. As stated, this driver will be on DOMESTIC hours NOT EU/EC and WTD as such doesnât apply.
Same as the buses. 5 hour driving stints with a half hour break then back on for another 5. We can work 7 days a week one week and 6 days the second week but we need a day off in a fortnight.

not sure about this if vosa inspected the yard im in at just now on agency they would have an absolute â â â â â â â field day. iâm sick tellin em but now i just give up, as long as my â â â is covered.
so if iam working from 7 am to 3 pm 8 hours day
then 12.0/clock i will take a break for 30 mins

As youâre on domestic rules you don 't need to worry about the 6 hour rule just take a break whenever you like, so 20 or more minutes at some time in the day should be fine for the general WTD which is what youâre working to.

i started a 7.10 drove untiull 11.33 that stop start as you do with a bin lorrie.
so had a 30 odd mins break so pressed break on tacho
iam out of scrope on tacho but after driving 10 mins the break started to flash again?
checked tacho and still running out of scope.
is there a fault on tacho. phoned the transport manager and he say its ok?

No itâs not a fault on your tachograph itâs just the way it works.
The only thing that happens when you put the tachograph on âout of scopeâ is that it marks on the record when you went out of scope and when you came back into scope, it doesnât actually affect how the tachograph operates.
As far as Iâm aware the tachograph will still â â â â â at you about taking your break but as youâre out of scope you can just ignore it.
You was right to check that the tachograph was still on out of scope though

I donât think Iâve ever actually had a break whilst the tachograph was on âout of scopeâ but anyway you donât need to come back in scope for breaks, actually thereâs no point in putting the tachograph back in-scope because if youâre not driving in-scope on a particular day you donât need to show the breaks anyway, so just press the 1 button to put the tachograph on break
